Tier 2 dependents questions

Post by Cristina88 » Sat Sep 26, 2020 11:56 am

Respected Gurus, Mods,
Hi all,

I am on tier 2 general & applied for ILR last week. I have 3 dependents & have questions related to them:
1 - spouse: he moved from tier2 ICT to tier2 G dependent in country & will be eligible for ILR (completing 5 years in May 2021). Along with his regular job , can he volunteer to coach kids football at a local club? Its pure volunteering & no pay/salary involved. Is it allowed?

2 - kid born in UK: If & when I get my ILR, how soon can I apply for my 4yr old daughter’s British citizenship? How can I apply for that ?

3 - kid born out of UK: For the kid born out of UK, he has to wait for both the parents to have ILR right? Can he apply for ILR at the same time as my spouse? Just fyi, he currently has non-UK passport & we travelled out of UK using that passport few times.

4 - Naturalisation of dependents: Once my spouse & kid not born in UK get ILR, do they have to wait 12 months for applying for naturalisation or can they apply with me (ie 12 months after my ILR if/when I get)?

Thanks a lot in advance

Best regards

1. When did he switch to dependent visa exactly?? He is free to do any work except for the restriction in his Brp card.

2. Once you have your ilr and BRP card. It is form MN1. You should ask citizenship questions in the British citizenship sub forum as the questions are not relevant in the tier 2 topic or sub forum.

3. Apply when spouse applies. Your passport statement is irrelevant.

4. Your spouse has to wait 12 months unless you are British at any time before that. Your spouse cannot apply when you do, it will be refused. Child can apply when you do provided they hold ilr and your spouse holds ilr.

He switched from Tier 2 ICT to Tier 2 General dependent in May 2016.
First BRP: 25 May 2016 to 4 Nov 2018
Second BRP: 8 Nov 2018 to 17 Oct 2021.

So based on this, he is eligible to apply for ILR on/after 25 May 2021 right ?
Please note that when I switched employer after Nov 2018 on tier 2 general, we didnt reapply for dependents visa.

Yes, within 28 days before the 5th anniversary of the initial dependent visa start date.

Oh, so 28 days applies on dependent to ILR as well. As their initial dependent BRP date is 25 May 2021, they can apply for ILR 28 days before so after 28 April 2021 right ?
Thank you so much CR001 !!

Yes. The 28 days concession applies to all visas.
