ILR - from date of issue of entry clearance or entering the UK

Post by Rajja78 » Thu May 28, 2020 3:05 am

It’s regarding my ILR – Long term residence –My solicitor is advising to go with date of grant of visa for applying my ILR 10 year route visa. Please find her advise to apply ILR application date:
“eligibility to apply after 10 continuous years in the UK. Qualifying period can start from either of the following:
 Date of visa grant -26 Aug 2010
 Date of entry to the UK- 9th Oct 2010
You need to decide which date to use, I would suggest your date of visa grant (26 August 2010). Ten years later is 26 August 2020. You would be eligible to make an application for ILR LR 28 days before the end of your qualifying period, which will be 29 July 2020.” This is based on 276 A;
Lawful residence is defined in paragraph 276A of the Immigration Rules as a period of continuous residence in which the applicant had one of the following:
“existing leave to enter or remain “
My current Tier-2 ICT is expiring on 30 Aug 2020. I am confused and please advise on this .

ILR - from date of issue of entry clearance or entering the UK

Post by CR001 » Thu May 28, 2020 6:12 am

The date if visa grant is ONLY applicable to those who regularised their stay WITHIN the UK, or an illegal migrant who got discretionary leave to remaon for example.

In all cases of visa issue date outside the UK, for the purpose of long residence ilr, it is the date of entry that determines the start of your residence qualifying period.

Set (LR) application 10 years route

Post by Rajja78 » Sat Sep 26, 2020 8:49 pm

Hi there,
I am in the process of filling the application for Set (LR) 10 years route. I came in to the country on 9th Oct 2010 and my 10 year time period is completing on 10 Oct 2020 - I understand that we can submit the ILT application before 28 days to 9 Oct 2010 ( i.e. 11 Sep 2020).
There is a question in set (LR) application “How long have you lived in the UK”?
Is it okay to fill there as 9 years and 11 months in the application- please suggest?
Thanks

Hi there,
My long waited time for ILR 10 years is over now.
I am in a oscillation state whether to apply ILR in a normal service ( which takes up to 6 months to get results) or to wait for a priority services to resume so that it will be done in 24 hours. ??
Looking for a wise suggestion here. Please Suggest
Thanks,

Only you can decide what you want to do. Strangers on an internet forum can't help with that decision. Super priority is unlikely to be available any time soon anyway. Even when it is available, it is not a guaranteed service of a quick decision.

Check the SET(LR) timeline thread.
The average time for a decision appears to be around 4 months.
