I am asking on behalf of a family member. She is an EEA citizen with settled/permanent residence. She has a 16/17 year old brother who is no-Eu and is dependent on her and so she wishes to apply for him to come to the UK. He is currently living outside the EU. The EU settlement scheme states you can apply for dependent relative but which form does she use and what are the requirements?

She previously applied (end of 2019) for a EEA family permit and was refused due to low income and proof of dependency. Is the EEA family permit the same as the EU settlement scheme? Does she deal with the issues raised and reapply with the same EEA family permit form or is there a different form we need? We are a bit overwhelmed and not sure if things have changed since January 2020.

He is also underaged with no other family member to support him. Does this have any weight on the application ?

Minimum income requirement for EEA family permit

I am struggling to find if there is a minimum income requirement when applying for EEA extended family permit (for a brother). How many months of payslips are required ? Would 3 months be sufficient or could that be rejected ?

Also asides from the following are there any other requirements? :

- DNA results proving sibling relationship
- Dependency proof
- Sponsor's proof of EEA nationality (and settled status)
- Sponsor's income

Hello

For the purposes of immigration, there are:

- [Close] Family members: such as mother, father, spouse, children... etc.

- Extended Family members: everybody else and this includes a brother

If an extended family member is outside the UK, he must apply under the EEA EFM. He cannot apply from abroad under the EU Settlement Scheme as this option is open only to close family members.

There are no specific hard rules when it comes to the EEA national revenue and the numbers of items proving the dependency. You just have to demonstrate that as much as you can.

EEA EFM as usually a hit and miss. You need to a strong application and a lot of pieces of evidence in order to maximise the chances of a positive outcome.

Will they still be processing these applications after 31st Dec 2020 , as we are hoping to apply again in January when she has 3 months of full time income.

She also has her mother who she wants to apply for. I know her mother would be a bit easier as it would be the EUSS application and there is no income or dependency to prove. But since the deadlines are fast approaching and her brothers are separate applications, is it worth apply for her mum before the Dec 31st deadline and the brothers whenever her income proof is ready ?

Currently she was thinking of just applying for them all at one time so that (hopefully) they can arrive together. Is this risky ? Thanks for the help

Whatever you want to do with the EU Settlement Scheme, do it before 31/12/2020.

In Jan 2021, it will be too late for that and you would have to find a suitable route, if any, under the new regulations in place by then.

Oh, I thought the 31 Dec 2020 deadline was just for EU nationals to move to the UK by and that they can still apply for family members and for their own pre-settled/settled status until June 2021 ?

I heard for family members who are already in the UK by that date. Otherwise, they would have to use UK immigration routes.
