Police Register Problem

Post by garlic20 » Sun Oct 04, 2020 2:15 pm

Hi all,
I submit all documents and completed visa extension nearly 1 month ago for me and my wife. And waiting my new brp and my wife's(dependent) brp. But my wife is not in the UK now. And middle of november my son will apply to brp for dependent. Ofc for applying ,my son needs my new brp and i hope it will come in 2 weeks. My son is 6 months old btw.
If my new brp comes in 2 weeks, i need to make appointment for register to police. But my wife is outside the UK, so what should i do?
Should i send mail to police and seek advice? or Should i go to my homeland, wait to my son's visa and come to UK, then i go to police and say sorry we r late because of these reasons?

She cannot make an in-country extension application from outside the UK.

If she extended while she was in the UK, then be careful, as there may be other complications:
If a person with an outstanding application, travels outside the CTA, the application does not give them any right to re-enter the UK to receive a decision on their application. They are liable to be refused entry, unless:
• they are allowed to re-enter the UK with a different type of leave
• their existing leave has not yet expired and is not cancelled at the border

If the person has transferred onto section 3C leave because they made an in-time application and their leave expired before they left the UK, their section 3C leave expires when they leave the UK.
If a person makes an application for further leave but then leaves the UK with extant leave and that leave expires whilst they are outside the UK, they will transition onto section 3C leave.

Yes, our visa is expired end of may 2020. We applied to visa end of April. But because of Covid, HO delayed everything and published mobil app. After we finished the application, my wife and my son went to homeland and ofc visa expired already. But i waiting my wife's and my brp and get visa extension without problem. Ofc they shouldnt went but an emergency situation, my wife had an operation at hospital so i didnt have any choice.
If police gives me appointment 3 months later, i guess i can solve every problem. But im not sure

Before the online application process and passport copies being permitted, they may have treated her application as withdrawn, if she requested her passport back for travel outside the UK. However, if she didn’t have to request the return of her passport and never submitted the original, then I’m uncertain what can happen.

HO didnt want our passports, because we applied from mobile app. Our passports still with us. Because of Covid, HO changed system and no need to send passport anymore. And also my wife went to our homeland with her passport. Only my concern is police registration, how can i delay my appointment or get 2-3 months later? I am living in essex, thats why i cant choose date from online. I saw people who living in london can choose dates thats why np for them.

Police registration lateness shouldn’t be a problem. I’m more concerned if other complications arise.

Her absence from the UK before the decision presents an anomaly that may clause complications in the future.

If she left the UK before her leave had expired, then Section 3C would apparently preserve the continuity of her leave until the decision at least.

With the way the rules are currently written, I believe the prerequisites for treating her application as withdrawn are not satisfied. But it’s possible that they may claim otherwise or not to process her application.

UPDATE!!!
I wanted to update. Finally today i ve received email from HO and HO confirmed my and my wife's 3 years extensions . Now I am waiting to our BRPs.
So only my concern is police registration anymore. I ll go to my homeland and apply dependent visa for my son from my homeland. After that I ll return to UK and go to register. I hope I can register without any problem.
