I recently asked a lawyer about this, and she gave a very plausible description of what's likely to happen:

As there are many people in a similar position, the state will try to fight this off to the end as you will set a precedence for others...

...if you win, this will "open the floodgates" for others, therefore you will have to expect a rather bumpy ride.

That's a ride I don't want to take for my few Euro's, but for you it seems possibly worth it.

So - hats off to you if you go ahead with this, and please let us know the details !!

P.S. - does anyone know whether such a claim becomes time-barred at some stage?

Here is an amusing one. My wife and I will be moving to the UK in the next few months, im expanding my business and opening an office in London.

It took us two and a half years to get the proper EUFam card from the Irish.

It took only one and a half days to get a UK settlement visa from Dublin.

Amazing!

But at the moment it could take you more than the allowed six months to get the UK Residence Card... Not so amazing.
