Residence Requirement

Post by sk1984 » Fri Oct 16, 2020 11:53 pm

Hello Guys,

Just want to be sure about the residency requirement for BC (applying as a spouse of a British citizen) as I am confused reading guidelines. Below is my travel history. We are planning to apply (submit the application) on 27th Oct 2020. As I understand, I should be in the UK on 28th Oct 2017 (this is satisfied). Along with these 270 days (before 3 years) and 90 days (12 months before) is satisfied. What I don't understand is this bit "Most applications that fail do so because applicants have applied even though they cannot satisfy the residence requirement to be present in the UK at the beginning of the residential qualifying period." .Could somebody let me know if I am OK as far as the residency requirement is considered?

Not outside UK for more than 270 days during 28th Oct 2017 - 27th Oct 2020.

@CULLINAN, Thank you very much. My current Indian passport expires in Nov 2020. With this covid situation, I am slightly confused about whether I should renew my Indian passport or not. If I don't renew Indian passport and the citizenship process takes more than 6 months then I would be in the soup as I need to visit India (don't know when). As I understand, if I renew my passport and then apply for citizenship, I can go to India based on my Indian passport and BRP. (until I attend the citizenship ceremony). I was reading in the below blog that unlike visa application there is no travel restriction outside the UK (for citizenship application).

If you do not want to travel to India:
Apply, passport expiry is irrelevant.

If you want to travel to India:
You only become British when you attend the ceremony not just approval. Approval may take 2/6 months and ceremony takes 4/5 months on top of that due to corona. You are free to travel before ceremony on your Indian Passport but obviously in this case, you will have to renew your passport.
