Post by amnaali03 » Thu Oct 22, 2020 8:38 pm

Dear all,
My first visa extension on 10-year route is due, but I am unsure in which category i have to apply. Please see the attachment for more information. Please guide me about;

Essentially the same application you made in 2017. See here for current details.

If you meet the financial and English language requirements, along with the other requirements,
you'll be granted the visa on a new 5-year route to ILR.

If you're unable to meet the financial and English language requirements but meet the other requirements including EX1(a) as mentioned in the letter, you'll be granted an extension on the 10-year route.

2. Current BRP & Passport to meet the Immigration status requirements.

3. 6 months payslips, 6 months bank statements & employer letter to meet the Financial requirements.

3 & 5 above isn't needed if applying under FLR(FP).

What leave did you have when you applied in September 2017?

Hi Korekt,
Thanks for reply. In 2017 i applied on 5 year spouse route, sent pay slips, bank statements and all income proof with my application. But they not accepted that and said that you failed to fulfill the financial requirement. Instead of 5 year route, they put me on 10 year route, please see the attached letter above. Now I am Ok on 10 year route, just want to apply for next first extension.

In my view, I have to apply for FLR(FP). No need to prove financial requirement & English test. Just need some letters from my kids schools, GP etc.

Please correct me if am wrong.

Regards

Did you ask for reconsideration or even appeal the decision at that time?

As mentioned above by Korekt, You do not need to meet the financial requirement & English test when applying for FLR FP and the application forms online will generate the list of supporting documents to submit in support of your application.

I meant the leave you had before the 2017 application.

My husband had a Tier 1 entrepreneur visa then, and I was on dependent on his visa. In early 2017, my husband got ILR and I applied for 5 year spouse visa route. Instead of 5 year route, home office put me on 10 year route. My husband and 3 kids, all have British passport now.

I see.

I take it your husband applied for ILR based on 10 years residence.

It's fine to extend on the 10-year route. The documents are as outlined above except the financial and English language requirements, and evidence of your relationship with your children as you've outlined above.

Have a go on the online form here. It will also generate a checklist of docs to submit based on your answers.

I take it you would consider applying for ILR based on 10 years residence yourself.

Thanks Korekt for your help. One hopefully last question, which option in start i should take, Partner / child / parent /or on Private basis? I think wrong option can lead to wrong application.

Thanks again for this.

Hi Korekt, just filled application form, at the end it's saying for financial requirement. I think, may be at the start I should select another option, instead of partner route. Any suggestion?

It's a generic form which covers more than one leave to remain application.

You will need to answer the questions to indicate that you're not meeting the financial requirement and English language requirements.

A cover letter will also be useful to point this out.

Hi,
I started to fill the FLR FP form through 10 year partner rout, but it ended in FLR M. Is that Ok? Should be FLR FP at end?
Thanks
