Study Break on Tier 2 Visa

Post by AN1515 » Mon Oct 26, 2020 1:21 pm

Hi,

I have a Tier 2 (General) visa since January 2019. I am planning to go on a study break for masters for 9 months from August 2021 - April 2022 in the UK itself (Tier 4) and then come back to work on Tier 2.

Questions:
1) Would this break my Tier 2 "continuous residency" and hence refresh my 5 year countdown to ILR?
2) Would I need to go through the 12 month "cool down" period?
3) Would the new Tier 2 visa issued after graduation have to be used for 5 years before applying for ILR?

Has anyone gone through this process? Any help would be highly appreciated.

1. Yes. For ilr based on tier 2, you need 5 years continuous tier 2 residence. Tier 4 doesn't count.

2. Probably yes.

3. Yes.
