Post by mkhan83 » Thu Oct 08, 2020 8:12 pm

Hi there/seniors and gurus
I just received ILR on the basis of TIER1 Entrepreneur (Date of decision 27/09/2020)
Here is the complete history of TIER 1 route
Initial Visa granted = May 2014
Extension Applied = May 2017
Extension granted = March 2018
ILR applied = March 2020
ILR granted = September 2020
Question
I have already been in UK for 6 years as an TIER1 Entrepreneur migrant
Can I apply for Naturalisation now???
Or
I will have wait 1 more year and apply in September 2021

Unless you are married to a British citizen, it is mandatory to hold ilr for 12 months before you can apply, regardless of how long you have lived in the UK.

You must wait 1 year after ILR unless you are married to a British Citizen.

Please do not tag your questions onto someone else’s topic. You will have to complete 5 years residence before you can apply for Naturalisation unless you are married to a British Citizen.

Post by mkhan83 » Fri Oct 09, 2020 10:21 pm

Dear Zimba/CR001/CULLINAN
I have a UK born Child (born before my ILR). I have just the guidance related to MN1 form and came to know that following documents will be required/uploaded to support the application
1) Child birth Certificate
2) Parents marriage certificate
3) One of parents settled status evidence (BRP)
4) 2 Referees declaration
Question
Is the above document list is fine???
Do I need to provide my passport (Pakistan) copy as well
Thanks

The documents 1-4 are fine. You will need a consent declaration for the child also. Your Pakistani passport not needed. For more info read the following topic. But keep all your follow up questions in your own thread.

Re: UK born child Naturalisation

Post by mkhan83 » Sat Oct 10, 2020 9:31 pm

Thanks Cullinan for your help.
The link you have pasted in above comment I have gone through with the link. Really informative for me. Baby girl mentioned in the link already had her home country passport. My baby was born 8 months ago, does not have a passport or National ID card of parent’s home country.
At the moment baby has got only one document that is Birth Certificate
Here are few questions while filling Online MN1 form. Please just double check my answers
(Online form has 6 steps to completed. I have completed first 3 steps. Remaining steps are Declaration, Pay & Further actions)
Online form asks
1- Are either of the parents of the child (as stated in this application) applying for naturalisation as a British citizen on an AN form?
My answer is NO as I just received ILR. Will apply Naturalization next year.
2 Have you lived at your current address for 5 years?
As baby is only 8 months old so not possible for baby’s 5 year history
My answer to this question is YES
3-Child’s country of nationality
As baby does not have any passport/travel document/ ID card of parent’s home country. What is baby’s nationality???
4(a)- Do you have a valid national identity card?
My answer is NO
4(b)-Do you have a most recent expired national identity card?
No
4(c)-Do you have a travel document?
No
4(d)- Explain why you are unable to provide a valid form of identification.
As I was born in UK.

Are answer to 4a,4b,4c & 4d are correct, as baby only have UK Birth Certificate. Does not have any identification document of Parent’s home country.

Online form generates the documents checklist and states the following

From the list of documents below, provide as many as you can. Tick each document to confirm that you have read the requirement, even if you cannot send it. If you are unsure about any of the evidence, read the guidance.
One of the documents checklist is asking for----
If child has a passport then provide this with your application. If baby does not have a passport then you must provide another officially-issued identity document. This could include an official travel document or national identity card.
5- Providing above evidence is necessary??? As I don’t have any of above. Only I have is child’s UK birth certificate
6-Two Referees declaration
I have filled in the details of two refrees in the online form. How can I get the paper based declaration form???
Your prompt reply will be very helpful for me

3) Child will take on your nationality.

4d) Child is born in UK. UK Birth Certificate is enough to prove identity.

5) UK Birth Certificate is enough. Nothing else needed.

6) https://visas-immigration.service.gov.u ... on_MN1.pdf

All the rest above is OK.

Dear Cullinan/CR001
I have arranged the second referee. But I am facing difficulties in arranging the first referee who is engaged with the applicant in professional capacity.
I contacted my GP surgery, receptionist said we charge for doing the non NHS work. So they charged me £50 (BAC). But after 2 days received a text message from the surgery that we do non NHS work only for those who are registered with the surgery for at least 3 years. Our records show that neither the father nor the mother registered with the surgery for 3 years. We are sorry we can not help you at this time. Your payment will be refunded in your account.
I tried to contact 2 health visitors as well
One health visitor said over the phone we do not do any non NHS work
Second health visitor has been sent a text message as well email for the request of being a referee but she did not reply
Now I will try to contact my local pharmacist to act as a referee as he professionally engaged in terms of prescribed and non prescribed medicine
Questions are
1-Can a pharmacist act as a referee?
2- If, for example, pharmacist is not ready to act as referee then what is the next option as applicant is only 9 months old.
Thanks

You have already done enough. Add a cover letter and explain the same. HO is not strict when it comes to referees in case of young children. Arrange another referee as per the ADULT requirements (even if not engaged with the child in professional capacity). No issues.

Dear CULLINAN
I hope it will be the last question
I have filled the application form. I am just filling DECLARATION SECTION
Which option should I choose
1-I am the applicant
2- I am the representative of the applicant and have been authorised to act on their behalf and have discussed and confirmed the content of this application with them
Applicant is only 9 month old
Which option should I choose

Thanks

Re: Attended Child UKVCAS appointment

Post by mkhan83 » Mon Oct 26, 2020 1:21 pm

Dear CULLINAN
I applied on 23 October for child registration as British citizen. I got an appointment for 26th October which is today. Just finished my child's appointment.
Lady at the appointment looked totally untrained.
She kept on asking child passport or any travel document to proceed. I explained the child is only 9 month old and doesn't have any proof of identity except UK BIRTH CERTIFICATE. Then she called the supervisor/manager. She also said the same that the system is asking for the applicant to provide passport. Anyways they took my signature on a form that responsible adult is unable to provide child's passport.
Another funny thing she said that system says to scan the Birth Certificate twice. Applicant only scanned and uploaded one copy of Birth certificate
Dear CULLINAN is there anything to worry about???

This is not new that UKVCAS staff is not trained with rules. They only go by the checklist.

Did the documents checklist generate child’s passport? As far I know, if you chose the correct options in the online form, the checklist would not have generated the child’s passport in the checklist.

Anyways, no need to worry. It is not needed.
Also, scanning document once is enough.

Dear CULLINAN
I have just gone through pdf file of visa application form. Also while filling the online form. It asked
What is your nationality? I filled Pakistani. I have to choose nationality As I can't go ahead without selecting nationality.
Application asked why you are unable to provide passport
I have been given 3 or 4 option in the application form I selected the option as I was born in the UK
I believe I have filled the application form correctly
First I have read the MN1 guidance then took advice on this forum. Also read some useful threads of MN1 application on this forum.
I am pretty hopeful there isn't a mistake while filling the form
Now CULLINAN I quoting exactly what Checklist says
"If Mr Mohammad has a passport then provide with your application. If Mr Mohammad doesn't have a passport then you must provide any other travel document or national ID card"
Waiting for the reply
