Re-acquiring Indian citizenship after OCI & passing it to new born child

Post by Bobthemoggie » Tue Dec 08, 2020 3:08 pm

Hi helpful memebers,

What is the process of re-acquiring Indian citizenship, after holding OCI Card for 3 years.
Situation: Acquired British Citizenship & OCI 3 years ago & before that mother(applicant) was holding valid Indian passport.
Mother living in India for last 1 year. Minor child born in India during summer year.

Question 1: Will it be possible to gain Indian citizenshio straight away now, after holding OCI for 3 years?
Question 2: Will mother be able to pass the Indian citizenship to the child, after acquiring Indian citizenship now?
Or Indian passport application for the child be rejected as mother /father weren't holding Indian citizenship at the time of child's birth?
Question 3: If mother acquired Indian citizenship, what is the grace period for using the British passport for travel ?
Question 4: What are the rules from Indian authrities to surrender British passport ? (Do they provide any grace period)
Question 5: Does mother need to have Indian passport if we've to apply for Indian passport for the minor child? or mother's Indian registration/naturalisation certificate be suffice?
Question 6: Will mother be able to apply for OCI card again, if she regains the British citizenship in short period of time / do not renounce the BC altogether?

Kindly advise
Cheers,

Have you done any research on what is required? A simple Google search would have answered quite a few of them. Not sure what you mean by "summer year"

Read this first:
https://www.vfsglobal.com/india/austral ... a_OCI.html

1. You need to hold the OCI for 5 years, and the last year must be spent residing in India. To gain Indian citizenship you need to surrender your British citizenship. So the answer is NO.
2. Does the child have an OCI? You might be able to surrender British citizenship and apply as a dependent minor.
3. 3 months only - above that you incur fines
4. Surrender your Indian passport first. https://www.vfsglobal.com/india/uk/Surrender.html
5. Registration/Naturalisation certificate is sufficient
6. Possibly not - the authorities might want to know why you are doing such a thing. This is definitely not normal behaviour to swap citizenships for convenience. There is a high chance that you will be rejected the second time.
