Tier 2 salary

Hello friends

If someone is on T2 visa where the employer had to meet minimum salary requirements before issuing CoS. I can see the salary requirements have dropped since the skilled worker visa was announced . Can the employer reduce the salary or it has to be in line with minimum threshold that was in place when the T2 was issued?

Your salary has to meet the minimum salary requirements for Tier 2, if you want to switch to the new Skilled worker stream then you are free to do so but note that the salary level that needs to be met is the higher of i) the minimum salary requirements for the skilled worker visa stream or ii) the relevant 'going rate' for the relevant job. There are not many professions where the experienced rate will be less than £25K.

My role was added to the shortage occupation list and the minimum salary requirements have dropped massively . Do I still need the Tier 2 salary threshold that was set before my role was added to the shortage occupation list since that’s when I applied and received the visa ?

Think of Tier 2 being a totally separate system to the skilled worker route. Each system has it’s own rules and the rules are fixed by the conditions in play at the time the COS was issued. If your COS and subsequent visa has been under tier 2 then these are the conditions that apply to your entry and leave to remain.

Can an employer issue a new COS, subject to Appendix Shortage Occupation List, and the employee apply for permission to stay under the Appendix Skilled worker using the new COS, if the new COS is more advantageous?

Already seeing this happening. Employers are seeing this as a salary saving and skills surcharge work around
