Hi,
Our situation 1: I am a British citizen with two kids who are British as well. My wife was my dependent in Five years route. Recently 15th Jan' 21 (28 days early based) she has become eligible to apply for settlement (ILR) and I applied Set(M) on behalf of her. She got appointment on 15th Feb'21. I have never claimed any benefit other than child benefits and we are private tenant without any agreement as landlord is my Cousin.

Question:

a) Would it be good idea to claim benefit (full or Partial) right now. I don't wanna continue my job as it is stressfull and I am already in long time sick leave (3months). I have full-filled my wife's Five years route as per her visa's terms and condition.

b) The house we are living in is a three bedroom house which we share with some other people. If I can get an agreement from my cousin to claim benefit and we produce that someone else shares with us in the house for the other room (as I am elgible for two bedroom house only) would it effect any to housing allowance. or how can I best do it?

c) I did apply for housing long time ago but assessment didn't allow me to be registered as i was living in Three bedroom house which council found me living in a comfortable zone. would I be able to ask the council (London borough of Newham by the way) to reassess my appliction or it will still be declined as I am living in Three bedroomhouse?

d) Planning to get my parents apply for tourist visa for the third time (twice refused already as case worker weren't happy with parent's finances). If I am in full benefit or partial benefit (24 hours work or earning arund £750 p/m) can I sponsor my parents for the living place and food. or what would be the best in terms of their Visa application. Last two times I provided my finances but they didn't bother about my finances. I am dying for my parents to grant visas.

Any professional or experienced people's advice will be highly appreciated. Thanks in advance.

You should speak to Citizens Advice. Perhaps an immigration advisor too untill your wife has ILR?

Giving up work and claiming benfits can cause a 3 month sanction
You don't have a tenancy agreement but must have one to claim some benefit money towards rent.
You are renting from a realtive.
You say you only claim Child Benefit but are taking about only working 24 hours a week (I assume you mean between you) which is part of the old, short lived welfare benefit called Tax Credit, which is being replaced by Universal Credit. UC requires both parents to work in any job, unless they have an excemption.
Your wife is No Recouse to Public Funds until she has been granted ILR. Unlike the old welfare benefit called Tax Credit, you cannot claim extra benefit money for somebody who is NRPF.

Each council decides who they will register to go on their long waiting list, for their very limited (especially in London) housing. You can ask them to look again at your application, but the decison to house you or not, is theirs.
