ILR questions on combining Tier 1 Entrepreneur and Tier 2 General

Hello respected members

I am bangladesh national.

My initial grant of leave to remain(tier 1 entrepreneur) issued in April 2014 to April 2017

During this period I was outside UK from July 2015 to Jan 2017 to expand business in other countries

Applied for extension April 2017 but was refused Nov 2017 due to no employee start date in payslips

re-appled in Nov 2017 with correct documents .. extension was granted in Sep 2018


I switched to tier 2 general sep 2019 and the visa was granted till sep 2022.

My questions are as follows

1) Am I eligible to apply for ILR June 2021? I came back to the UK Jan 2017 minus 6 months( 180 days outside UK) which is June 2016.

2) Do I need to provide the reason why I have been outside UK for such a long time?

3) In between my passport was expired, got a new passport, however, I lost old passport. Do I still need to provide all pages in old passport too?

1) Yes but you need to ensure that you do NOT have more than 180 days in ANY 365 days (rolling basis)
2) No
3) You are advised to submit police report for the lost passport

Thanks for your response.

I am outside almost for 18 months which means my continues period was broken, Do I need to mention my absences back up to July 2015 or up to June 2016 is fine

I am a little confident in applying ILR this April.

This might be my final question. Since my continues period was broken and returned UK in Jan 2017, do I need to stay 5 years again from Jan 2017 or its okay to count 5 yeas continuous period from June 2021 back to July 2016?

My apologies if this question seems ambiguous, just wanted to double check again with the esteemed gurus from this group

You can count 5 years backwards form any date as long as you do NOT fail the absence requirement over that 5 years period.

Hi Zimba and respected gurus,

I have to reopen the thread because I found something in the below link which gives an indication that I have to count my 180 days period from the date I re-entered (Jan-17)into the UK.

Can you guys please confirm is my understanding correct?

Page 19, paragraph 5 saying as follows
If the delay is more than 180 days, you can only include time after the applicant
entered the UK in the continuous period calculation.
In my case its not first time entering into the UK , with the valid leave permit I left in July- 2015 and entered re-enter in Jan-2017 .

Kindly advice. I am under deep depression now.

I assume that applies only to people who did not enter the UK with their new visa, that is why it is under Period between the issue of entry clearance and entering the UK
