student marrying a british citizen partner-

hello , need to guide a friend who is marrying a british citizen. getting mixed immigration advise from different people so he is confused.

he is from india , came to uk on student visa last year february 2020 , his sponsor was a reputable univeristy. he met his partner soon after and they applied for permission to get civil registration done via local council and got approval from HO to go ahead with registraion.

but covid happened and council is not going ahead with registration for sometime now. meanwhile he stopped going university and they reported him to HO and informed him to leave the UK within 60 days. he still has 40 days left out of these 60 days.

can he still go ahead with his registration with the council or he has to return back to india and get married there and apply from there ?

yes , the british partner is a student and also works. she meets the required earning threshold for spouse visa.

they are confused because they do have council permission ( they had a formal interview by council registrars ) to do registration for a few months now but due to covid , couldnt register and now the parnter has been told by the univeristy that since he has not been attending they have reported him to HO and have told him to leave the Uk within 60 days.

is the permission to register still valid , can he register and go back to india and apply as a spouse. or they will have to get married in india now and then apply
