I think your wife should have applied for ILR under 319E prior to 1 December 2020, before the PBS dependant rules were changed. Why did she wait so long?

I think another member may have a similar problem with the changes in the rules.

I’m unsure if an ILR application will succeed or fail?

Give it a go. Rely on legitimate expectations? If they refuse because they changed the rules on 1 Dec 2020 and forgot to cater for dependants of former Tier 1 (General) ILR holder, etc., then complain in the strongest possible ways.

Hey RockSims

Hope you are doing good.

Can you please update how you dealt with the situation?

As per the suggestions from Vinny and also doing some research on gov.uk website, there is no option coming to renew Tier 1 general/Entrepreneur PBS dependent visa till it qualifies for ILR. (I mean if there are a few months left till the 5 year period is completed, one would need another extension to make it up for remaining months)

Moderators please don't block the thread as I am not putting in any query, I am following the thread and just need to update my information.

Many Thanks

This is ONLY about Tier 1 General dependants NOT Tier 1 Entrepreneur dependants. The PBS rules remain in place for Tier 1 Entrepreneur applicants and dependants
