Will I be counted as overstay?

Hi there,

I’m applying for SET(M), my visa will expire in 23 March 2021. I know it’s last-minute as I have been so stressed lately due to the covid19 and I didn’t even know about my decision until today. So I have just paid the fee (about 2,450 GBP), but I cannot get an appointment before 23rd March, the earliest one available would be in April. Would it be counted as I am overstayed? Thank you. I’m really worried about it.

34G specifies the date of a valid application for a leave to remain. If the date of a valid application was in-time, i.e. before the visa’s expiry, and the application is undecided when leave expires, then Section 3C protects you from overstaying.
