ILR - T2 General - Returning Expired BRP to Home Office

Post by anub2016 » Thu Mar 18, 2021 1:52 pm

Hi,

The Home Office asks that the BRP from a previous grant of leave is returned to them, as it is no longer valid.

Could I please request the Experts to clarify the following?

* What is the Deadline to return the T2 General BRP in post?

* Should it be returned after the new BRP has arrived?

* When cutting the BRP in half, shall I cut it such that the biometric chip on the BRP is rendered invalid?

* Shall I add a letter containing the relevant details when sending the BRP back?

* Is there any other mandatory action that I must take to remain compliant?

Many Thanks.

Simply cut it and send it back. Those details are not important. That BRP will be invalid anyway

Many Thanks Zimba.

What is the Deadline to return the BRP please? Its 2 days since the email has been received from the Home Office Atlas.

I am yet to receive the hard copy of the letter and the new BRP.

ILR BRP

Post by anub2016 » Fri Mar 26, 2021 1:44 am

Hi,

My 'Place of Birth' as shown on the Passport and as provided in the ILR application form shows both the City and the State e.g. 'Los Angeles, California'.

However, the BRP card does not show the full name of the State i.e. the name of the state has been truncated e.g. 'Los Angeles, Calif'

Could you please advise if this is fine? Is it because there is a limit on the number of characters that the BRP can show in the 'Place of Birth' field?

Many Thanks.

It is fine. Must be due to character limits on the card

Thanks Zimba.

Before returning the BRP card for the T2 (General) visa back to the Home Office, do I need to get a photocopy of the BRP card certified by the Post Office for any purpose in the future?

I have seen some references in the forum, but not sure what is that relevant for!

Many Thanks.

Good idea to keep a photocopy of it for your records, as part of your Immigration history.
Also keep proof of posting.

Thanks vinny.

Actually, I intended to say that I have already sent my Tier 2 (General) BRP back to the Home Office, but I only have its scan in the form of a PDF.

I do NOT have any "certified" photocopy of the BRP. Is that an issue?

Is the Scan sufficient to keep record of Immigration History?

I have kept the Certificate of Posting though.

I cannot see any issues. Your current BRP supersedes it.

Many Thanks vinny.

For the purpose of applying for the child's first British passport, what are the current rules to prove the ILR status if a person has already returned their ILR BRP card to the Home Office?

A friend of mine does NOT have any "certified" copy of his ILR BRP. What should he provide to prove his ILR status for the purpose of his child's British passport?

Many Thanks.

Note: If you have a child born in the UK while you are an ILR holder, then your ILR BRP confers child’s British citizenship. Then I suggest you keep the intact ILR BRP as proof.

HMPO may give your friend a hard time.

Could his British Citizenship details not be used for his child's British passport?

Isn't it mandatory to return the ILR BRP after Citizenship?

If he had British citizenship prior to the birth of his child in the UK, then yes. His British citizenship would also make his child British.

I think there are provisions to retain an ILR BRP when it confers British citizenship to a UK born child.
