Hi, I really owe to this forum for many important information while I was waiting for my Status. Following is my timeline.

Tier2/Tier 4 visa switching to EUSS Direct family member

Application: 26th Dec 2020
Passport Received by HO: 30th Dec 2020
Passport Received by Me: 28th Jan 2021
Biometrics: 4th Feb 2021
COA Issued: 20th February 2021 (received by post)
Decision (Pre-settled Status): 05th April 2021 (by email)
BRC Card: Within 10 days (by post)

Some important information I gathered:
1. Being a non-EU applicant, it was a paper application. Hence, Biometric Invitation and COA (Certificate of Application) were received by post and not by email.
2. Should your visa expire after submitting an application and before any decision is made, you can continue to rely on your current rights (it is mentioned on the EUSS website). "There’s no change to your status in the UK while your application is processed." I also confirmed the same by calling UKVI.
3. In addition to point (2), I have also been informed that COA protects you if your visa is expiring. COA is valid for 6 months. However, in my case, nothing was explicitly mentioned on my COA.
4. All the mandatory checks are conducted after COA is issued. The checks include Eligibility checks, residency (less than 5 years or more than 5 years), not sure about the background checks. Only identity check is done before COA (which includes sending of your document/passport, and submitting your biometrics)

For me, it nearly took 1.5 months after COA to receive my status (provided no additional information was asked).

I have a similar situation.

Currently hold Tier2 visa which should expire in a few months as I had to leave my job.

Application: 12/02/21
Biometrics: 11/03/21
COA - still nothing
Decision - still nothing

I've applied with Tier2 BRP online. At biometrics appointment UKVAC for some reason scanned my passport instead and also submitted a form for change in id, stating I should have applied with a passport. I'm a bit puzzled as to why she needed to change IDs and whether it is something that is causing delays in processing.

Has anyone experienced a similar thing?

The 31st June 2021 deadline is for people who do not currently have a status under the new EU Settlement Scheme. Since, you already have a Pre-settled Status, that deadline doesn't apply to you. Once you finish your 5 years of Continuous Residence in the UK, you will be eligible to apply for Settled Status. Hope that helps!

Hi my settled status application is now in court.

can i apply another settled status application while other one is pending at court ?

because i think i am now eligble for settled status thats why my application is now in court.

but HO think i am eligble for settled status end of 2022.

because HO really mess up my case at court from the beganing.

Kind Sir, your query makes no sense. In your previous post you said you had pre settled status which will expire in 2024, that means you applied for EU settlement scheme in 2019. Now you’re saying your settled status application is in court because you think you are eligible for settled status, however previously you mentioned you think you will be eligible for settled status in 2022. Furthermore, you now want to make another fresh settled status application whilst you are defending an application in court.

Sir, do you see the many holes in the plot? In order for anyone to help you out, first you must explain your situation both honestly and cohesively.

Hi sir, first of all i have got my visa 2017 but applied for pre settled status 2019 and i got it.

but i made appllication of eea route 2015.
some two years home office mess up my case and i won every appeal.

but HO said your time start when your issued a resident card which was 2017 and you are eligable for 22 at the end.

but my point is why HO is not counting my time when i won my appeal at FTT since from their i won every appeal.
so that i think i am already eligable for settled status from 2015 to 20.

thats why my application is in court that was Ho fault not my fault, so my time should be start when i won my appeal not from resident card.
why i have to wait for another 1 and half year for settled status.?

can i have your openion for this l,

can i make another fresh Setteld status application if court take time while other one is pending at court ?
Can anyone please give me answer ?

What about someone without passport ? The caseworker guidance stated BRP is a form of acceptable ID.

Hi @none

Why did you use paper application ? Was your EU sponsor also a British national ? As a direct family member ,even as non EU I thought it would be online application ?

Not sure about cases like that. But if you do have a passport, you should apply with it. BRP will only make things more complicated.

What does the COA say in terms of right to work? Does it confirm a right work?

Is anyone received NON-EU family member card (EUSS BRC). Just want to confirm is new cards have a NATIONAL INSURENCE NUMBER all ready on its back or need to apply after receive it.

Thank you for sharing! It looks like the COA itself doesn't confirm a non-EU citizen's right to work, rather it asks the employer to use the Employer Checking Service. Since I'd be on a EUSS Family Permit when I get the COA, will the Employer Checking Service show that I have the right to work?

Ladies and Gents,
This is my timeline;
I am a non-EU citizen holding a pre-settled + BRC(as a family member of EU citizen) and did applied for EU settled status on 2th of March 2021 with my spouse. My spouse(EU national) granted in 2 weeks. I did received COA in same day through e-mail and since than no update. I did request an update on 2th of April and responded on 7th of April with a very basic explanation. It was a general explanation of apologize and so on. I see that recently people did get around 1 month and a half but my application did passed that time. When I did applied I had to upload(Marriage Certificate, proof of missing few years based on NINO check, BRP copy and spouse ID copy). What should we do? I don't see any recent update from others and they didn't request any additional documents either.

They take their time aren’t they.. It was very quick for my spouse to get it and generally EU citizens get their status even in a day or two. It is gonna be 2th month and I am not bothering to call them to hear saying wait..
