5 years period requirment

Post by khalchris99 » Sat Apr 17, 2021 2:00 pm

Hi everyone,

I am an EU citizen, my ILR was obtained in 09/2019
I lived in UK since 2009.
Full time student in UK: from 09/09/2009-15/01/2017
Comprehensive risk insurance (04/04/2016-03/04-2017)
Working full time from 01/12/2016.
I have life in UK test and English language certificate (my degrees were taught in English in UK universities) and all other required documents.

Can I apply for Citizenship through the ILR?

I am confused because of this statment in the UK.gov website says:

If the Home Office receives your application on 20 June 2022, but you left the UK on 10 June 2017 and returned to the UK on 25 June 2017, you will not qualify. You’ll need to wait until 24 June 2022 to apply.

I left UK to visit my family from 24/04/2016-11/05/2016 in that year. Does that mean I need to wait until 12/05/2021 this year to apply? or I am good to go?

Thank you all in advance

From Guide AN:
You must have been physically present in England, Wales, Scotland, Northern Ireland, the Isle of Man or the Channel Islands on the day 5 years before the application is received by the Home Office.

Be aware that naturalisation is not a part of any immigration pathway, but a separate process with its own laws, rules and procedures.

It is a mandatory requirement (i.e. one that the Home Office has no discretion to disregard) that the applicant must have physically been in the UK at the start of the five year period immediately preceding the date of application.

So, yes, if you were absent for that period in 2016, you should apply on or after 12th May 2021.
