TIER 1 dependant ILR questions

Dear Senior members/CULLINAN
My dependant/wife has the following Immigration history
Visa issue date 26/04/2016
Arrived in the UK 12/05/2016
Applied for TIER1 extension in May 2017
TIER 1 first extension granted April 2018-April 2020
Applied for 2nd Tier 1 extension in April 2020
TIER 1 2nd extension granted Oct 2020- Oct 2023
Never been out of the UK for more than 180 days
Questions
1) What is the earliest possible possible date she can apply for ILR
2) Which Visa Application Form has to be filled out, please paste relevant link
3) I have following documents in place to apply for her ILR. Are these enough???
  • Her passport (Current and previous)
    Her BRP
    Life in the UK
    B1 English Language from Trinity College
    Marriage Certificate
    Proofs of living together of last 2 years
    Driving Licence (husband and wife)
    Motor Vehicle insurance Certificate showing the same address for both of us
    Child Birth Certificate showing the same address of parents
    Bank Statements (husband and wife)
    Mobile Contracts (Husband and Wife)
    HMRC letters (Self Assessments letters)
    Payslips
    Tenancy agreement (joint names)

Assuming you got your ILR via the PBS route.

1) She can apply earliest from 26/4/2021 minus 28 days.

2) SET(O)

3) Your documents are fine. She needs cohabitation documents for the last two years from the date of application. Could be any source from what you have listed. Ideally 3/4 sources evenly spread across last 2 years i.e. every 3/4 months. Ideally in joint names, otherwise top up in sole names but same address.

Dear Senior members
I am about to apply ILR for my wife. She spent 5 years in UK as dependent partner of PBS TIER 1 migrant.
(i got my ILR as PBS TIER 1 entrepreneur migrant in October 2020.)
I have just gone through the immigration rules paragraph 319 E (d) which states
(d) The applicant and the Relevant Points Based System Migrant or Appendix W Worker must have been living together in the UK in a marriage or civil partnership, or in a relationship similar to marriage or civil partnership, for at least a continuous period of 5 years,

My question is
Do i need to provide proofs of living together for 5 years or last 2 years

One more thing
Both partners have digital online banks statements. Can i use digital bank statements to show proof of living together (of last 2 years) or i need a bank stamp on online bank statements?

All online/digital evidence is accepted. You need documents from 3/4 different sources.

Dear Senior members, CULLINAN/CR001
I have almost completed the relevant visa application form for my dependant wife (SET O).
At the end, system has generated a document checklist as follows
  • 1-The passport issued by Pakistan for Mrs ABC
    2- The language test certificate for Mrs ABC to prove the level of English language
    required
    3- Evidence of Mrs ABC's immigration
    status in the UK
    4- Declaration signed by Mr XYZ to confirm
    consent for the Home Office to request
    verification checks
    5-Current Biometric Residence Permit for Mrs ABC
    6- All previous passports, travel documents or
    national identity cards that you have used to
    travel to or remain in the UK
At the end of the application form, i am also able to download a family contest form having 3 parts
Part 1 is for the applicant (my dependant wife/partner)
Part 2 is any person having joint account with the applicant.
Part 3: Any body who is financially supporting the applicant
Question

I believe family consent declaration PART 1 is applicable to the applicant. (my partner)
PART 2 and PART 3 is not applicable on me as i don't have joint account with my partner

If i see the above documents checklist (Number 4), what kind of declaration Mr XYZ (Me, PBS TIER 1 entrepreneur migrant) has to provide.

Applicant signs part 1. You will sign part 2. It is not only for joint accounts. It could be any joint named documents. You must be providing cohabitation documents. That is the declaration needed (#4).

I am also surprised that documents checklist is not asking about
1- Cohabitation documents
2- Marriage Certificate (this document has been provided in previous applications in 2016,2017 and 2020)
Is it normal that documents checklist is not asking about the above mentioned documents?

The checklist is generic. You need to follow the immigration rules and guidance note!
