Declaration from the Employer stating that the Old Sponsorship Licence has been transferred to the Current Company

Hi All,

I was sponsored TIER 2 General from a company and after 3 years it was acquired by another company and all the Old Sponsorship Licence has been transffered to new company as per Govt. guide lines.

Does any one have the format of a Declaration from the Employer stating that the Old Sponsorship Licence has been transferred to the Current Company?

It would be great if you can give that format.

Sponsor licences are not transferable. The company that took over your original sponsor must apply for a sponsor licence, if they don’t already have one, if they wish to continue employing any migrant worker who was employed by the company taken over.

As far as you are concerned para C4.10 of the guidance provides:

Workers who change employer under TUPE or similar protection do not
need to make a new application for permission, and the new sponsor does
not have to assign a new Certificate of Sponsorship (CoS) to the worker,
provided:
• the new sponsor has a valid sponsor licence in the relevant route and
has confirmed that it accepts responsibility for the worker, and
• the worker’s duties remain unchanged
