Irish Naturalization application

Post by Hamada2030 » Sun May 23, 2021 12:46 pm

Hi everyone ,

I am going to apply for Irish Naturalization next year and I looked at the application for last week. I would really appreciate if you can answer my following quires:
1. In 2019 I travelled to my home land in March for a visit and for PLAB one exam as there is no centre in Ireland and it used to be a requirement by the medical council for training post. Then I travelled to England to sit for the same exam in September 2019. In October 2019, I went back home to renew my passport which was going to expire on Oct 2020. In total, I was away for 44 days in total in 2019 and from the application form it is stated that it should be up to 6 weeks per annum.

2. In 2019, I had two speed penalty points in August and September ( 6 points in total).

3. In May 2019, I hit a car in stop junction and it was very gentle. I told the owner that I can fixed it privately if you agree to avoid increase in my insurance and she agreed. We did not call the Garda.
Unfortunately, she reported it and the claiming is still in progress and my Insurance company is dealing with it at present. I received a letter from the layer of my insurance company and at the top mentioned Circuit court and the name of that person versus my name. The layer told me my no claim points maybe affected and he told me this is nothing to do with the state and it is a civil issue.

I just need your assistance and advice about the above mentioned points and the effects of it in my application for Irish Naturalization.

Thanks so much

1. Just wait for an extra 44 days before you apply for naturalisation.

2. Two, not one, speeding offences, within the period of one month, is a significant issue.

3. Civil matters are not part of the naturalisation application. However, since you know that you have been reported to Gardai, you need to mention it in the application. It should not be a concern in terms of your application.

Thanks so much for your reply.

Regarding the penalty points I will be zero point by the time of application.

Regarding the accident I think she only reported it to the insurance company as I did not receive anything from Gardai.

I will wait 44 days for sure for that period.

Any other advice you recommend?

Thanks

Get your records from Garda, form below:
https://www.garda.ie/en/about-us/online ... -2019-.pdf

fill in "all records held by Garda Síochána" in the details section.

If you decide to apply for citizenship, give full account of the offences, fine receipts, letter of remorse, references from your friends or work colleagues, anything to proof that you're a good person and will be a law abiding citizens.

Nobody's perfect. People make mistakes. Your offences will not go unnoticed, but your subsequent history and behavior will also be considered.

Hi everyone ,

I hope this message finds you well.

Just wondering how do I calculate fiscal year ?

I came to Ireland in May 2019 and I got stamp one in June 2019. My permission was till February 2018. Then I got permission for 6 months based on the contract.

I need to answer the question, if I have been out for 6 weeks in a year in the last 5 yrs?

Thanks

Fiscal year is the year that starts from the date of your first permission/stamp.
You need to answer "yes" to question 5.6 and give details of all absences.

Your residence period is based on the dates of your registrations.

If your first stamp is from June 2019 to June 2020, that is your fiscal year 1.

Thanks for your answer. I had stamp by an immigration officer on 22 May 2017 in the airport and I got stamp 1 in June 2017.

First stamp in the airport I IS on 22/05/2017 with permission to stay till

22/08/2017.

Stamp 1dates:

26/06/2017 till 28/02/2018.
02/04/2018 till 08/07/2018.
09/07/2018 till 13/01/2019
07/01/2019 till 07/07/2019
25/06/2019 till 12/07/2020
12/09/2020 till 11/07/2021 (COVID Period)

Travel dates

Departure 08/03/2019 arrived 28/03/2019
Departure 04/09/2019 arrived 28/09/2019

Total days 44 days.

From the above I need your advice of how to calculate the start of my fiscal year and if am away more than 44 days in any of my fiscal year ? I need detailed answer please.

Does the first stamp in the airport counted ?

Can I travel in the last year before application ?

Do you recommend apply via a solicitor ?

Since there's no gap between your previous stamps (with the exception of COVID where the permissions are auto extended), you would be eligible to apply for citizenship from 26/06/2022.

For the purpose of calculating absences, you count the days of absences for:
- between 26/06/2017 and 25/06/2018,
- between 26/06/2018 and 25/06/2019,
- between 26/06/2019 and 25/06/2020,
- between 26/06/2020 and 25/06/2021,
- between 26/06/2021 and 25/06/2022.

For each of the year above, you do not have absences more than 42 days, so there is no need to exclude anything.

Landing stamps do not count as reckonable residences unless you are a refugee.

Yes you are allowed to travel for up to 42 days in any year, including the year before you apply for citizenship.

And no, solicitors are not recommended for straightforward applications.

I really do appreciate your answer.

Thanks so much for that.

I had just a gap after the first stamp 1 (end 28/02/2018).

Regarding, the solicitor, I had two fines (speed tickets). I checked they were in 24 June 2019 and 25 July 2019. I got 3 penalty points for each ( 6 in total). I paid the fine for both as well.

Q 1 :
Can I apply for cancellation if the FPN especially I was diagnosed with bulging disc in my neck and lower back

I also had an accident in May 2019. The passenger got sorted and the claim is still active for the driver. The case is in the circuit court at present and the solicitor of my insurance company informed me that by July 2020 this year it will be settled hopefully.

Q 2 :

Do you recommend apply for Irish Naturalization by myself?
