ILR Application date

Hi all,

I'm applying for ILR on behalf of my partner and trying to get my head around dates!

The first leave to remain commenced 18th July 2016. On the 27th Dec 2018 (within the 28 days of expiry) I applied for the Further Leave to remain (accepted and brp card issued 9th Jan 2019).

Just to add I used the premium service both times.

Just a bit confused as 30 months from the last application made is 27th June 2021 - that's less than 5 years, but the expiry date on the brp card is 6th Aug 2021. Just wondered why that date is what it is, and does that mean I have until then to apply?

Did you partner arrived into the UK on a spouse visa or switched from another routes to a partner visa within UK? When did she arrive in the UK?

She arrived in the UK on a fiancé visa earlier that year (March 2016) we married in June and then switched to Leave to remain in July. I assume that doesn't count towards the 5 years.

Correct, the time on the fiance visa does not count towards the residence requirement.

You start counting from the date the spouse visa was granted.

Gonna take 18/07/21 (exactly 60 months on) as the deadline then. Was really just curious as to why the expiry date on the brp card was 6/8/21.

If the FLR was granted on 09/01/19 as you stated above, then it would appear 28 days was added to the 30 months granted, in line with GEN.1.13., to take it to 06/08/21.

The last date/deadline to make a further application is the date the visa expires.

You may apply 28 days before 60 months.
