Switching from ICT to Skilled worker within UK

Hi,

I'm currently working in UK in ICT long term visa from 29th Dec 2016(visa validity) but I entered UK only on 16th Jan 2017. I'm looking to switch to skilled worker visa within UK but I have question on 5 years in any 6 year period criteria.

I was in UK in ICT short term until 14th Jul'16 (visa expiry 15th jul'16) from Aug'15 and then travelled back to India.

Please confirm how my continuous stay calculated ? Is it from Aug'15 (5 years 5 months) or from 16th Jan'17(4 years 5 months ?

In simple term , Am I eligible to switch to skilled worker within UK under my circumstances described above ?

Under the rules n force n Dec 2016 there was a 12 month cooling of period but even though you haven't been out of the UK for 12 months at the time you were granted the T2 ICT long term staff visa because an exception for complying with the cooling off period applied to those who had a T2 ICT short term visa beforehand.

However, this is all historical and has nothing to do with you applying to switch to a skilled worker visa for which you are eligible any time before your current leave expires.

Hi ,

I have biometric appointment in 2 days and I'm in UK for 4.5 years.

Do I need to upload COS and bank statements to UKCVAS prior appointment?
My employer selected fund maintenance as No in COS.

As you have been in the UK with valid leave for more than 12 months there is no need for you to show funds for maintenance when switching to the SW visa

it makes no difference what the employer puts in the CoS as you have been in the UK for longer than 12 months

Thanks for your help.
I have received my skilled worker visa approval and BRP as well.

My wife and daughter still in ICT dependent visa which is valid until Dec 2021.

Do I need to apply now for them to switch to skilled worker dependent or can apply before their current visa expiry ?

Please note I'm switching to new employer under skilled worker.

Your dependants can apply either now or at any time before their current visas expire. Their new visas will have the same validity date as your new visa
