ILR : Tier 2 (General)

Hi Zimba,

On this very pertinent note - I am taking liberty to ask a few questions, as I'm pretty much on the same boat as Kav.

1. Providing Continuous Residence Proof -

You mentioned no address proof is required earlier, so does that mean, we don't provide any addresses of where we've been staying since 5 yrs?

2. I did see the case worker .pdf for skilled worker migrating to ILR.(opposed to Tier 2) - I really couldn't gather any differences for document submissions between Tier 2 General & Skilled worker. Is it any different to the following -
a. Life in the UK
b. Letter from the sponsor.
c. Continuous residence proof
d. English Language.

3. Since I am a main applicant, my application category is set M ?

4. Any funds maintenance evidences we need give by any chance for past 90 days?

Do not tag your quesrion onto other member topics.

1. You need to state the addresses in the form if asked. Continuous rrsiece proof is the passport and all stamped pages. If you have dependents applying with you, you need two years evidence of cohabitation in both your names.

2. No difference.

3. No!! Set M is NOT relevant to tier 2 ilr. Tier 2 ilr you can only apply using form SET O. Form set m is for a different visa category applying for ilr.

4. No.

Set O - Continuous Residence Calcution

Good noon all,

I am sure it may be a repat post, however I would like to seek guidance on my days of continuous residence for the sake of absolute clarity. Please accept my apologies for being ignorant here.

My total days outside UK in past 5 years is as follows:-

7th July 2016 ---> 6th July 2017 = 23 Days

7th July 2017 ---> 6th July 2018 = 87 Days

7th July 2018 ---> 6th July 2019 = 29 Days

7th July 2019 ---> 6th July 2020 = 46 Days

7th July 2020 ---> 23rd June 2021 = 84 Days

(23rd June 2021, I will apply for ILR)

Question: With the law of consecutive fixed 12 month period till 11th Jan, 2018 and rolling calculation period thereafter, can you please guide me if I am in my limits of under 180 days each year within my 5 year period.

Your guidance will be highly appreciated.

To calculate the rolling basis, the exact period of absences must be known. That is what I meant not that you copy-paste the same thing again :?

Here is the breakdown of actual travel from Jan 2018 till date -

2018 -
3rd Jan to 20th Feb
28th Feb to 18th March
2nd Oct to 13th Oct
21st Oct to 6th Nov

2019 -
10th Oct - 3rd Nov

2020 -
14th Jan to 3rd Feb
16th Dec to 31st Dec

2021 -
1st Jan to 9th March

Mandatory checklist guideline - Set O

Hello,

I am about to submit my application and under the mandatory checklist, a requirement is asked which I am confused on -

1. Evidence of my immigration status in UK.

I was thinking it should be the BRP card itself, however giving current BRP card is added as a separate requirement in the checklist.

So, question is what is the difference between the two? (if any) If I just give BRP, will that answer to the evidence of immigration status clause as well?

Yeah, BRP is sufficient to prove your immigration status.

Sometimes same document can cover two or more requirements, so nothing to worry.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Declaration for Consent to Home Office - Set O (ILR)

Hello,

A quick question on mandatory documents again - I have been asked to have a declaration signed by me to confirm consent for the Home Office to request verification checks.

Q: Is there a standard format for this document? or is it a letter stating I give consent to HO to do the verification checks and self attest it?

Can someone guide me please.

BRP Appointment Clarification

Hi,

I want to take some guidance on whether is it possible to extend the appointment deadline given by UKVI for extreme circumstances.

My Case:
Application Submitted - Set (O) - 23rd June 2021
Date of BRP - 20th July, 2021
BRP Appointment + Document Submission Deadline - 24th August 2021.

I had to travel on emergency due to death in my family. I will not be able to reach back by end of August due to Rituals + 10 days mandatory quarantine in UK.

So, it is possible somehow to request the appointment deadline to be extended till 1st week of September by any chance? Or any other alternatives?

Your help will be greatly appreciated.

You should NOT travel outside the UK while your application is being processed or else your application is considered automatically withdrawn. This has nothing to do with your appointment deadline. You must return and apply again

Date of BRP - 20th July, 2021
And if your visa expires on the 20th July as you have indicated above, you won't be able to return to the UK as you won't have a valid visa.

You will have to apply for a visa again and start from scratch with a new 5 Year period.

Many Thanks.

So, with application already withdrawn - does that mean no refund? Considering, it was not even to a stage of BRP and no documents were uploaded? (only application form was submitted) - If not, Is there a way out I can write to Home Office and explain my case to get the refund at least?

CR - My expiry of current Tier 2 is in June 2022 - So, no issues in returning back.

I suggest applying to withdraw it yourself now. You will get a refund. Come and back and start an application from scratch

I tried filling the form with that above link and have following questions -

1. This form mentions about return of documents - In my case I haven't even uploaded any documents and not sent any passports. So, is it still OK to proceed with this form?

2. At the end on the declaration page - it mentions on 'no refund' will be given if I decide to withdraw the application. So, is that correct? Or does that imply on something different?
