Skilled worker visa rules for changing job after few years

Post by mmssaa » Fri May 14, 2021 11:04 am

Hi there,

Currently, it is hard to find a sponsor for my job role in the UK & get a skilled worker visa. Assuming I get sponsorship and then Skilled Worker Visa and after 2 years I decide to change my job(not changing role).

My queries are:
1) Since I already would have a skilled worker visa, do I still need to find a new employer who has a sponsorship license and who can give sponsorship?
2) If the answer to the above question is YES, then will it still be hard to find a sponsor then? Asking because I already would be having a skilled worker visa at that time.

Many thanks in advance.

Yes and you have to apply for a new visa with a new employer.

Impossible for us to tell you if it will be hard or not.

How many days will employee get to search for a new sponsor & get a Skilled Worker Visa before having to leave the count

Yes and you have to apply for a new visa with a new employer.
Thanks, I have a couple of questions here:
1) Does everyone get 5 years visa when they get Skilled Worker Visa?
2) When an employee decides to change the job, it was said that a new visa with a new employer is required. Does that mean the existing visa will be canceled? If yes, then how many days will the employee get to search for a new sponsor & get a Skilled Worker Visa before having to leave the country??

1. No, the visa length depends on the length of the CoS the sponsor assigns.

2. Yes,if a new visa is granted, your existing ilr visa is cancelled. If your new visa is cancelled and ukvi curtail your visa, you get 60 days.

Will there be any additional charges for a sponsor when generating a CoS for a year vs generating a CoS for 5 years?

Unlikely. The visa fee and IHS differs though.

You have said "ilr visa". ILR stands for Indefinite Leave to Remain. Does the same rule apply for skilled worker visa as well?

Typo on my phone.

If you get a new visa, your existing visa is cancelled

Traveling outside UK after Skilled Worker Visa is initiated

Post by mmssaa » Fri Jun 11, 2021 12:44 pm

Hi there,

I am on a Tier 2 ICT visa and my new employer would be applying for my Skilled Worker Visa soon.
Can you tell me if I am allowed to travel outside the UK once my skilled worker visa is initiated?

One more question - do I need to submit my original password when applying for a skilled worker visa?

No. If you travel out of the UK while an application is pending, it will be considered withdrawn.

Applying within the UK all documents are submitted and uploaded digitally.

Can you also please keep your question in one topic. Topics now merged!!

Won't I be given a stamp on my passport for "Skilled Worker Visa"?

No, when applying within the UK no stamp or vignette will be placed in your passport.

Accepting 2 job offers at the same time

Post by mmssaa » Sat Jun 12, 2021 9:12 pm

Thanks lolo2.

I have a small question:

I am in the UK and I have accepted 2 job offers: one with the UK employer and another with an Irish employer.

Is it legal in the UK to accept 2 job offers at the same time?

I signed the UK employer's offer letter and there was nowhere mentioned that I cannot accept another offer. I reckon no offer letter would have that in their terms and conditions.

Are there any possibilities that the UK employer may take any legal action against me for accepting another offer and not joining them?

Re: Coming back to the UK with Tier 2 ICT visa after ending employment

Post by mmssaa » Wed Jun 23, 2021 9:34 am

Hi there,

I am on a Tier 2 ICT visa and my last date with my current employer is going to be in a few weeks. I have a valid Tier 2 ICT for a few more months after ending employment with my current employer.

If I travel outside the UK after ending employment, can I come back to the UK before my Tier 2 ICT visa expires?

I think you asked this question before. If you travel abroad after leaving your current job, most likely you will be denied re-entry to the UK. Your employer will notify HO within 10 days after your last day at work.

The valid date of your current BRP is irrelevant.
