Tier 5 Religious worker extension denied

Post by puneetdwd » Mon Jun 28, 2021 9:32 am

Hi
I am member of local Scottish temple which uses only Nepali Priest to perform religious activities. He got one year Visa and then extended another that's the maximum ine can do inside country
When applied again we got below response :-

Its appears you may not be eligible for an extension of your current Tier 5 Religious Worker visa as per the Immigration Rules as you have already been granted the maximum time permissible in this category

The temple is unable to find another priest locally and even from Nepal it's hard to find as people not willing to travel due to Covid . Have written to local MP and MSP just generic response.

What are the options ? How can the temple make Jim stay longer on another category ? Is it possible for the organisation to sponsor him on Tier 2 ? Which category he can switch within country ?

Please suggest.

I think he may switch to T2 Minister of Religion, if he satisfies all the requirements.

The switiching requirements seems to be outdated as it's inconsistent with MOR 1.5.
A person applying for permission to stay as a T2 Minister of Religion must be in the UK and must not have, or have last been granted, permission:
(a) as a Visitor; or
(b) as a Short-term Student; or
(c) as a Parent of a Child Student; or
(d) as a Seasonal worker; or
(e) as a Domestic worker in a private household: or
(f) outside the Immigration Rules.
MOR 1.5. should take precedent over a more restrictive guidance.
