Upper Tribunal Permission To Appeal

Post by sk072021 » Tue Jul 06, 2021 11:36 am

My brief History
1. Came to UK as student - Dec 2007
2. Completed BA and MSC
3. FLR FP rejected in mid 2016
4. Since then 3 human rights application made
5. Have daughter born in UK and aged 5
6. Recent appeal at First Tier tribunal refused
7. Now I am seeking permission to appeal through First Tier Tribunal
8. What is the processing time at First Tier Tribunal?
9. What is the processing time at Upper Tribunal?
10. Success rate of getting permission at FTT & UT?
11. Success rate of wining at Upper Tribunal hearing if permission granted?
10. How long whole process might take?
12. What is prospective route to get regularised?
Would appreciate if anyone share the recent experience and any advice.
Thanks in advance
SK

Court procedures are outside the scope of this forum. We cannot tell you how long they may take and what to expect. You seem to have been an overstayer since 2016 and challenged the UKVI in the court several times. You may be granted leave outside the immigration rules but you then need 10 years to get ILR.

Dear Mr Zimba,

Thank you for the reply.
I made judicial review following my first FLR FP application when I was given out of country appeal right.
On my third application, I was given in country appeal right but it was refused by FTT.
Before my daughter turns 7, is there application or way to get leave outside the immigration rules?
Will it be wise to make a fresh application now?
Thanks

I do not see a way forward without being eligible. A fresh application will not get you a valid leave unless there is basis for it
