Spouse and Dependent Son Extension Visa: Does Pass in GCSE English taken in the U.K. school count?

We are applying for my wife and my stepson's extension visa. My stepson started secondary school in U.K after joining me and he passed the GCSE English (Grade C). Does that count towards proven '..English language abilities' criteria if he submits the board certificate in his application? I will be grateful for any help. Many thanks.

No it does not.

If he is over 18, he needs to do the English test.

Thank you, I thought so! So silly to take the A2 test when he's taken a much higher 'proven' test. Another money making ploy by the UK govt.

Please I need confirmation before my application in August 2021 to Extend my wife's visa. Will we be asked in the online application for our marriage certificates etc? It's not a problem to submit but we're being careful to follow exactly the application rules (to avoid over submitting supporting documentation having negative/unfavourable result). We satisfy all requirements for Extension Visa but from our painful experience with initial visa process, we want to avoid every possible mistakes.

yes submit marriage certificate with translation ( if it was not written in English). Also she needs to pass English exam A2, and submit her result certificate

There’s no English language requirement for children’s extensions (even when over 18). However, he may require an approved B1 test for ILR under 298(vii) and for naturalisation.

Thanks vinny. My wife and step-son are both taking A2 test this Sat via British Council - they didn't say anything about him not requiring to take test! He has just finished A Levels and been offered one year contract by his school to tutor first year A level students deemed requiring extra assistance in Economics and Maths from coming Sept! £150 down the drain...

Unlikely as British Council only gives refund on cancellation at least 5 weeks!! before test date .Any ideas how to go about getting refund? i.e. what rules/regulation to quote

I think an approved test provider should have the expertise to know that there is no requirement from the Home Office for children of all ages to take any A2 English Language test. It’s only a requirement for a partner’s or parent’s extension under Appendix FM.

I think applicants have a legitimate expectation to rely on an approved test provider’s expert knowledge of a test’s purpose.

I think the test provider failed to provide reasonable skill and care under the Consumer Rights Act if they permit an applicant to book or take an unnecessary test. If they sell a product that serves no purpose, then they may also be miss-selling it.

Thanks again vinny. Your assertions seems valid. We will contact B.Council using your reasoning and take it further with Trading Standards office. Will keep you updated.
