Change of employment, can I choose visa validity

Dear everyone,

I have been on Tier 2(General) for 4.5 years, so technically I just need half a year SW visa before ILR. I am in the process of change of employment where my new employer has provided a cos of 5 years. I asked my employer for a new cos of 1 or 2 years , but got a reply that it has to be 5 years since the job is advertised as permanent. Is my employer correct ？

If yes, then my question is:

can I use the 5-year cos to apply for a visa with shorter validity (say one year), by paying only IHS for 1 year ?

I am unfordable to pay a 5-year visa and IHS (with my three dependents who needs to apply at the same time).

Any help would be much appreciated.

If you get a 5 year cos ,you have to apply for a 5 year visa. You can choose a shorter length.

How long your employer issues a cos for is their choice/decision.

Sorry, I meant you 'cannot' choose a shorter length. You pay and will get what the CoS length is.
