To OVERTURN ECO'S decision I will....

Post by 688148256 » Wed Oct 15, 2008 9:54 am

As I have already mentioned in my previous posts, my mrs's settlement visa has been refused and now we are in process of lodging an appeal against the ECO's decision. I have come up with an idea of sponsoring my wife to UK as a visitor for 6 months of period.

Comment by ECO: "I am not satisfied your marriage is subsisting. I am therefore not satisfied you are intending to live together pemanently" If visitor visa is granted, we will be able overturn this phrase of ECO till the date of hearing.

Can I sponser my wife as a visitor to UK, alongside the lodged appeal for the settlement visa.

Hi, have you been in contact with the embassy to find out what is happening.
My husband submitted his paperwork for his spouse visa back in march,he had to go and do his biometric fingerprinting then call them in 2 weeks to find out if he was going to be interviewed which in our case he did. Then he had to go to New Delhi high commission for interview.

well the VFS agency..took the biometrics (finger prints) on the day of submission of application. She was told she should wait for the medical appointment call. Now its been over a month still no reply from the embassy or vfs..

online application status only says that the application has been forwarded to the high commission.

Is there somthing to be worried about!!!

No i don't think so,sounds fine to me, unfortunately its just a waiting game!! I think the high commission can take 4-6 wks so you should hear soon.
Has she asked at the vfs agency where she handed her application in????

yes, she did called them up after a week of submission...and was told that your application has been forwarded to the BHC.

I mailed VFS again after a fortnight and was told the same story..so basically its automated response from the guys at the VFS.

Usually they ask about how you met but as yours is an arranged marriage i think they will just ask how this arrangement came about, they will check your employment and accommodation to make sure you can support her without the need for public funding.
I think they will only call her for an interview if they need more information or if something is not clear in your application.

i spoke to the mrs ...she will be making a visit to the HIGH COMMISSION ON MONDAY..is this a good idea to find out the progress. I hope the BHC wouldn't get nasty to her...kos she will be there without any appointment or invitation.

Does she have to travel far??? you may find that they will not let her in!but not sure as we haven't done that.
Has she foned them before????that maybe better than making an unnecessary visit.

i think we shud give them few more weeks..to process.. anyways if we call, email or even visit them..the only reply would be...processing time for settlement visas are 3 months, so please wait...

Not sure about that,my husband submitted his application and heard in a week that he would be going for an interview then had to wait 2 months to go for it.He is now waiting for his visa to be issued and as far as i am aware when you get asked to come and collect your visa they also do your medical at the same time. That is done by letter.

Hi 688148256

I think i'm in the same boat as you...we sent our application for settlement visa at the Jalandhar VFS centre in mid september...and we still have not heard anything...my husband called the centre a couple of times but they repeat the same thing..its in process..i even emailed them..but same reply i got..settlement visa takes maximum 3 months..

im getting really impatient waiting...but i have faith is god...maybe no news is good news. if there was something missing in our application..they would have got in touch by now..but we havent heard anything since..so i dont know whats happening..

Did you manage to give them a call?..what did they say?

OKAY!!! I CALLED BHC TODAY AND THE INFORMATION THAT I AM GIVEN SOUNDS QUITE GENUINE..ABOUT THE SETTLEMENT VISA.

BASICALLY BHC SAID APPLICATIONS FOR SETTLEMENT VISA SUBMITTED WITHIN LAST 2 MONTHS HAVE NOT EVEN BEEN TOUCHED.

THIS IS DUE TO STUDENT VISA APPLICATIONS BACK LOG. THE PRIORITY IS TO COMPLETE THE STUDENT APPLICATION AS THE NEW TERM IN THE UK COLLEGES/UNI BEGINS IN SEP/OCT.

BHC SAID MAY BE FROM 15 NOVEMBER WE WILL BE WORKING ON THE SETTLEMENT VISA APPLICATIONS AND WAS VERY APOLOGETIC FOR THE DELAY.

SO IF YOU ARE TOLD BY THE BHC THAT YOUR APPLICATION IS IN PROCESS, DON'T STRESS YOUR SELF OUT ABOUT WHY PROCESS IS TAKING LONG. IN REALITY IT IS IN A DRAWER OF THE BHC.

hi 688148256,

Good Luck for your wife's interview..i hope it all goess well and she gets the visa...

i was just wondering how come the BHC said they havent even touched the settlement visa applications, which were submitted in last 2 months due to student visa back log, and that they may be working on it from 15th nov...so how come they called your wife for an interview so soon??...if i'm not mistaken...you had submitted your application the same month as we did...so im surprised the BHC mentioned all that to you when you called them up.

oh well...the good news is that we dont have to wait for an answer after the 15th nov..it means they are working on the settlement visa applications..slowly but surely.

To OVERTURN ECO'S decision

Post by 688148256 » Wed Nov 05, 2008 7:14 pm
