ILR application date

Hi all.

Thanks for this board and all the people contributing to it. it has been very useful for me during my tier 2 general visa history and now it is time to apply for ILR.
I do have a question regarding the 28 days rule.

1)
I do have a tier 2 general visa.
First visa issued date: 10/10/2016
UK entry date:10/10/2016
Can I apply for ILR on 13/09/2021 and go for super priority route? can I get approval even though it has not been absolute 5 years in UK?

2) My dependants (my wife and my son).
They do have tier 2 general dependant visas.
First visa issued date: 24/10/2016
UK entry date: 21/11/2016 (28 days after the visa issued date)
Can they apply for ILR on 27/09/2021 and go for super priority route? can they get approval even though it has not been absolute 5 years in UK?

Yes, if that is within 28 days before the 5th anniversary of the initial visa issue date. You can pay for super priority if the option is available.

Yes if that is within 28 days of the 5th anniversary of the initial visa issue date. Yes if super priority option is available. Note that if your application is delayed for any reason (super priority is not a guaranteed service), then their applications will also be delayed until yours is decided.

Just another question;

I found the home office letter from 16/09/2016 saying that my visa is granted, However my visa start date is 10/10/2016. This is what i requested at that time for to start due to notice time with my employer.
Also checked my first BRP and it is issued at 26/09/2016.

So which date is the best to use,

16/09/2016 minus 28 days
26/09/2016 minus 28 days
or
10/10/2016 minus 28 days.

BRP issue date is fine.

It is visa start date, not letter advising approval date.

Another question please?

Can I used an academic IELTS results taken in October 2015 to apply for ILR?

I used that certificate for my first Tier 2. The test centre is still on the approved list of UKVI but the test type is not. I think it was for IELTS for UKVI as at my form there is UKVI number on it. I have submitted it to UKVI in September 2016 for my first T2(G) which was granted.

You need a minimum of IELTS B1 level for ILR.

At the test report it indicated as CEFR Level C1 and all test results are above 7. So it should be sufficient.

The main question is "can i use it as IELTS academic" I could not figure out if the IELTS Academic is still at the list of recognised tests.

The gov uk says

You can use a B1 level qualification that’s run out if both of the following are true:

it’s on the current list of recognised tests
it was accepted for another UK immigration application, for example when you got permission to enter.
