That advice ONLY applies to UK born children. This is yet another example of solicitors being totally inept and incompetent. No. They should apply for ILR before their visa expiry and to avoid them being overstayers. Their application will be held until yours is decided. As usual, you were advised incorrectly by your solicitor. Both children's visas expired last year already. It would depend on when they arrived in the UK in 2010 and when their visas expired last year whether they have 10 years of lawful stay.
I came to UK in 2010 with 2 children on a dependant visa.
