Hi Team ,
Can you please advice on the below
Spouse details
1.spouse granted Tier visa in JULY 2014.
2.Spouse arrived in the country onTier2 visa in 2014 August.
3.Granted ILR in July 2019
My Details
1.Arrived in Feb 2010 on Student visa(Tier4 general)
2.PSW until Jan 2014
3. Applied T1 Entrepreneur in JAN 2014
4. Visa rejected in FEB 2014
5. Applied for appeal and granted permission until OCT 2014
6.Withdrawn appeal
7.Made in country switch as PBS(TIER 2 dependent)
8.Granted visa from NOV 2014
My query : As my spouse has granted ILR as a dependent when would I qualify under 5 year route ?

But we have a gap of 4 months as my spouse Tier 2 visa was issues in July 2014 and I have switched in Nov 2019 and hence I don`t qualify yet under 5 years route as there is a difference of 4 months and I believe we should be together on the same visa for 5 years in order to qualify ?
Please if you could clarify this confusion then it would be great

You could have applied for ILR in November 2019, 5 years minus 28 days from the date your dependent visa was issued. Not sure what is confusing you!

My Spouse ILR was granted in JULY 2019 and at that time I was not qualified as I was short of few months to complete 5 years and that`s why I have applied for ILR dependent extension which I have now until SEP 2022.
So as per your advise I am already qualified since NOV 2019 under 5 year route and I can apply anytime now ?

You can apply at any time before your current visa expires. The point is, you could have applied a long time ago already and there was no need to wait.

I have started filling SET(o) form
In the application form it asks for my spouse current immigration status as my spouse been granted ILR now and in dropdown list it doesn't show ILR.
So as a dependent while filling the application form do I need to select TIER 2 general and provide the details of the visa when my spouse arrived in the country or should I provide most recent COS with a different employer which my spouse had it while ILR was granted.
Please let me know your thoughts

Hi
Can you please help me with the following queries
I will be qualifying for ILR next month as a Tier 2 PBS dependent under 5 year route where my spouse is already on ILR
1.Is set(o) the correct application to fill in order to apply as a Tier 2 PBS dependent
2. In the application form it`s asking for sponsor`s details where I have entered details of previous COS. Is this correct ?
3. Enter biometric permit details ? Do I need to provide spouse`s most recent BRP details i.e ILR ?

Yes you are correct ! Due to personal circumstances I couldn`t apply for ILR though I am qualified
But now I have to as my current leave will expire soon

I would go for ILR as no point of paying the heavy IHS surcharge fees for extending.

It was never not available!! It simply depends on UKVI capacity if you get the option or not as everyone wants the fast decision route.
