I hope someone could give me an idea.

I applied for SET (LR) on 18.03.2021 , and applied for my spouse as Family Route VISA on 27.03.2021.

The ILR is being approved today , but did not get any decision for spouse family route visa application.

Will they consider her application as brand new application after my ILR decision with standard 8-12 timeline which she already applied 3.5 months ago , or should I also expect her visa to be approved soon in a few weeks time?

Thanks for the claifications.

Please note , both applications was standard.

Is there anyway I can chase her application as its been over 12 weeks already applied for?

If you applied for flr m for your spouse,that application will only be considered and processed once your ilr is granted, not before or at the same time as your ilr is processing.

Your spouse didn't qualify for flr m until your ilr was granted.

Many thanks for the kind reply. Just to clarify..

Does it mean her timeline just started today , so we would need to await another 6-8 weeks to get decision for her application ?

Her route details as follow:
Online Application : 27.03.2021 ,
Biometric appointment: 29.04.2021

My ILR application : 18.03.2021
My ILR desicion: 05.08.2021

The note was on spouse FLR application:

The applicant has a pending application with the
Home Office for settlement under the 10 Year Long
Residence route. He has built up 10 years on the
basis of being in the UK under Tier 2 ICT visas. The
current application reference number is
XXXX. The application was
submitted on 18 March 2021. Please join the
applications together and hold the applicants
application until such time as her partner is granted
ILR.


If that is the case we need to await another 6-8 weeks , if they consider it a new application from today onwards, we will go for cancellation of the application , and re-apply via priority route.

One more question. Can I get refund also for the cancellation and re-apply for the same visa type when she is abroad? Is there any risk doing this process after cancellation ?

her visa expired on 29.05.2021 , same as mine. She was on ICT Intra-company dependent visa.

If you withdraw her application, she becomes and overstayer since the date her visa expired. This will have implications later on if she wishes to apply for citizenship.

You don't get a refund for applications if you have already enrolled biometrics. You lose the fee you have paid.

Thanks CR001 , the information you provided is very useful.

We tried our chance by calling the customer service team , and escalation the case via MP today , hope we will hear something soon.
