Applying for a Zambrano Derivative Residence Card

Hi

my sister is on leave to remain and she is sole responsible for her British child. She wants to apply under a Zambrano Derivative Residence Card.

Question:

1- Is it possible to Applying for a Zambrano Derivative Residence Card now?

2- Which application form she will need to complete

3- What are required documents

4- Is there any fee for this application

I assume you mean that your sister wants to stay in the UK? This is the other countries board. There is a long, active thread about zambrano on the EEA-route applictaion board; for those who want to stay in the UK.

If your sister does not have NRPF on the visa she has at the moment and is claiming UK benefits, you might want to pay attention to that relevant part in the HCLC article above.

Since that article was written, the European Court has sided with the UK, again, on UK benefits having a benefit "right to reside". Before that case, the EU took the UK to court for not paying benefits on the benefit "right to reside" requierment and the UK also won that case, with the EU having to pay the costs. The Supreme Court was wating for this latest European Court verdict on UK benefits haivng a right to reside, before they rule on the Fratila case.
