British citizenship for my children

Post by a.s.b.o » Sun Aug 29, 2021 9:22 pm

I am an Irish citizen with a document certifying permanent residence in UK issued in 2017. I had both my kids born outside of UK and Ireland. The eldest is an Irish citizen and never applied for UK's EU settlement scheme. The youngest child is non-EU citizen with a settled status (Indefinite leave to remain) issued under EU Settlement scheme. We are all currently in UK.

What are their entitlement to British Citizenship (if any) or when would they qualify for one?

Thank you

Children born abroad qualify to apply for citizenship when either parent also applying or is already British and the other parent holds ILR.

In addition to CR001's advice above, a quick note that children born outside the UK don't have an entitlement to British citizenship. Applications for registration of children born abroad as British citizens is at discretion, not an entitlement.

How old are the children and how long have they lived in the UK?

Thank you secret.simon. Children are 3 and 1. The 3 y.o spent nearly 2 years in UK, the 1 y.o arrived to UK ca. 3 months but has already been granted settle3d status based on my entitlement to the said status.

What is the UK immigration status of the other parent?

Neither child qualifies to apply for citizenship.

One parent must be applying too or already be British and the other parent must have settled status.

Thank you CR001 for clarification. Does it make any material difference if (1) I wait for the second parent to gain settled status or (2) apply for BC straightaway?

The second parent needs to have settled status.

It is you apply at the same time or are already British AND the other parent having ILR/settled status.

All clear, thank you for taking time to clarify our position. As a run-away question, what form should we be using once time and documents are right to make an application for BC?
