Set(LR) or Set(F) for Child

Hi,

Need some advice to proceed with my child ILR application. I tried searching this board but couldn't locate much info on Set (F) so posting this query.

- I (Father) received the ILR under long residence route on May 2021
- Mother received the ILR under long residence route on Sept 2021
- Child currently PBS dependent (based on my previous ICT visa before my ILR)

Both Mother and Child had more than 180 days absence in year 2012, reason being to support my in-laws medical treatment. Child was only 1 year old at that time and so accompanied along with the mother.

As for Set (LR) application, absence no more than 180 days is a key criteria, I tried the Mother's ILR application alone with the doctor letter for her absence and held back my Child application. Fortunately the mother's application was success.

Based on the above scenario, should I go for:
1) Set (LR) application for Child with the same doctor letter for the absence of more than 180 days
or
2) Set (F) application for Child as both parents got ILR

Which option could be more certain and have less risk of any rejection.

I've one more query on the eligibility of SET F. Eligibility as stated in the guidelines below.

1) you’ve had permission to be in the UK as your parent or relative’s ‘dependant’
2) you are or will be living with your parent, parents or relative
3) you’ll be supported and accommodated adequately without using public funds
4) you’re not married, in a civil partnership or living an independent life

For item 1 (you’ve had permission to be in the UK as your parent or relative’s ‘dependant’), is there any restriction on how the 'dependent child' visa been obtained, like family visa?

In my case, my child has the dependent visa based on my earlier Tier 2 ICT. Will this suffice for the Eligibility item 1?

Yes. That is is irrelevant under SET(F)
