New (final) extension till 1/2022

Post by Redstar33 » Thu Sep 16, 2021 10:52 am

Hi guys, can anyone help me on this, I don't really understand as the writing in this is quite vague.
Off Topic
This final temporary extension of immigration permissions means that people who held a valid permission to be in the State in March 2020 are legally permitted to remain until 15 January 2022, even if their Irish Residence Permit (IRP) card has expired and they are awaiting a new one.
Does it mean it's automatically apply for everyone, even if their application got rejected when submitting for a (temporary) renewal earlier? OR it's only apply for people who's awaiting for their card, AND people who only got the acknwoledge email (but not the second email which confirms their cards are out for delivery)?

Thanks!

Just send your query to the department.

Thank you! I've already sent them emails, but seems like it'll be ages until I got a reply from them, sadly.

@Redstar33, did you get any reply from INIS on this?

Thanks.

If you have an IRP card with the expiry date between March 2020 and January 2022, that card is automatically extended to January 2022.

It does not matter if you have applied for any subsequent temporary permission and if you have been successful in that application. The only exception is that if your rejection letter says your current permission has been revoked.

@littlerr thanks for the clarification. I got a quick question, what if the EU Treaty rejects the application/review but doesn't mention that stamp is revoked however mentions that "You don't hold valid permission in the state" would that temp stamp4 still be valid?

thanks in advance.

If it says you don't hold a valid permission now, that means your permission has been revoked.

It's rather a new process that DBEI is now allowing Stamp 4 holders to apply for employment permits. There aren't many known examples or court cases that we can refer to, so the short answer is we don't know.

Based on the wording of the recent update from DBEI on 1/10/2021, it sounds like that they will want you to provide explanation as to why you want to switch it to an employment permit, and you need to prove that you have already contacted INIS to try to get a different permission such as a temporary stamp 1. Whether this represents the legal view of DBEI or INIS, we don't know.

So my understanding is that they want you to contact INIS to at least try to get a temporary stamp 1 or other permissions. You should show documentary proof that you have tried to do that, regardless of whether that attempt is successful or not.

They are in the ‘latest updates’ section on the DBEI employment permit website.
