Tier 2 dependent who has not pass Life in the UK or B1 test

Dear All,

I would like to know what is required for my wife who did not pass her life in the UK test and B1 tests, can she still apply with me in the same ILR application form (Form Set O) or does she needs to apply separately, if so what is required and what kind of form she needs to use?

She cannot apply for ilr if she has not passed both tests. You cannot include her in your ilr form at all.

When does her visa expire??

She will likely have to apply for a PBS dependent extension, which is a 3 year extension.

Thanks for your quick reply, her current visa will expire at the end of Sept. However, there are many questions on the form regarding the partner, so shall I leave them. Also, what is the other document that you are referring to?

ILR Eligibility for my 4 yeas son

Hi All,

I would like to have an advise on this case please. I have 4 years son who born in the UK while I am on Tier 2 general visa. I am going to apply for ILR at the end of this month with my other kids and my wife will apply for PSB dependent as she couldn’t attempt the English test nor the life in the UK.
My question is , do I need to include my son with my ILR application or with his mum application?

A UK born child doesn't need ILR. Once you have ILR, you can apply to register the UK born child as British on form MN1.

Thanks for your reply, I just want to clarify one thing please , I have another two daughters who born in the UK but they left the country and then came with my after 6 years of their birth as Tier 2 depends and their visa will expire in at the end of this month when I am going to apply for my ILR, my question is:

Do I need to include them in my application or wait till get my ILR and then register them as British ? Remember. Their visa will expire while I am waiting for my ILR decision.

Discretionary Leave Or PBS depends

Dear All,

I would like to know which form I need to use to apply for an extension for my wife application. I am going to submit my ILR application by the end of this month with my children, but my wife did attempt the English and the life in the uk tests. My question is what application form I should use to extend her stay . I have been received mixed messages some are saying use “Discretionary Leave form FLO(R) and other are saying use the PBS dependent form . Could you please advise which form I need to use for my wife case and how many years can she get?
