Tier 1 General PBS Dependant applying for ILR

Post by rohitys » Sun Jul 04, 2021 10:47 am

Hi all,

We are about to start an application for my wife who has been on PBS Dependant Leave to remain. Below is her immigration history
  • My wife was first granted a PBS dependent visa in 2015 for 1 year due to the validity of my Tier 1 General Visa
She was then granted an extension on her PBS dependant visa for 3 years till 2019
We then decided to extend her PBS dependant visa and was granted a further 3 years till 2022
During this period I was granted British citizenship in 2018 under 5 years Tier 1 General + 1 year ILR route

Are we good to proceed with Set (M) for her ILR? Kindly advice

SET M is the wrong form.

If she has held a PBS dependent visa for 5 years she can only apply for ilr using form SET O.

Thanks for the quick response, also one other clarification

Select a category in which you are applying for indefinite leave to remain.
Will this be - Tier 1 or Appendix W dependants

Also, my wife's degree was taught in English and she has a degree certificate in English (we didn't submit anything extra other than this for her previous extensions as a PBS dependent)

Would this be sufficient for her ILR without the need for a UK NARIC evaluation certificate?

A pbs dependent visa never had a requirement to meet the English requirement.

She needs the naric assessments for a foreign degree or the B1 English test.

Thank you for the swift response. Can I please confirm we are good to proceed with this? https://www.trinitycollege.com/qualific ... SE-grade-5

Wanted to clarify regarding cohabitation documents.

I understand we need to submit documents for 2 years from at least 3 different sources if I use a joint bank account statement does it matter how much balance is in the account?

Hi all,

We're uploading the documents & below is the list we are going with for the last 2 years

Joint Bank Statements
Council tax
Electricity
Rental Agreement

The outstanding questions we have are

1. Are we okay to upload these in the 'other optional documents' section of the UKVCAS website
2. This is the declaration form we are uploading https://visas-immigration.service.gov.u ... ration.pdf which was not available while filling the Set (O) form or even after we completed the payment. We had to download this separately, is this right?
3. The original documents my wife is carrying along with her on the day of the appointment are Passport, BRP, Life in UK test letter, B1 letter and Marriage certificate. Is this sufficient or are we meant to take even the cohabitation documents which we uploaded.
4. Consent form: My wife signs part 1 and I sign part 2. I don't need to sign part 3 even though we are using joint bank statements, correct?
