ILR absent calculation

ILR absent calculation

Hi. I am planning to apply ILR next week. My query is that I took piad annual leave(I travelled out of UK) starting from Monday but I left UK in Friday night after attending the office.

My company absent letterhead states that approved leaves was from Monday l.

Does this impact my application?

No impact on your application, you got your leave approved and backed with letter.

Thanks for the reply. isn't it absent dates mentioned in application should exactly match with company supplied letter?

I am not sure I was clear with my query, Here I explain again the two issues that I had with my previous employer.

I worked for a XYZ company starting from 13 Feb 2017 to 28 Sep 2018.During this tenure I had two paid leaves where I travelled out of UK to visit family.

These are the approved leaves and dates mentioned in letter head

1) 03(Monday) July 2017 to 14(Friday) July 2017


but I travelled on 30th(Friday, after attending the office) June 2017 and returned back on 15th July 2017 i.e on Saturday.

So my in my application I had to mentioned the absent from 30th June to 15th July 2017.


2)This is regarding the second annual leave with company, where I travelled out of UK during my notice period with the company and the travel was approved. but on my return date i was not employee of the company as my notice period ended 2 days before on my return.

This is has been agreed before I took the leave.

So the second leave mentioned as

03(monday) Sept 2018 to 28(Friday) sept 2018.

But I travelled on 31st(Friday evening) August 2018 and returned 30th(Sunday) Sept 2018.

Please note that my employment ended with the company on 28 the Sept2018 i.e last working day of that month.


So clearly the absent dates in my application are not exactly matching with dates mentioned in my ex company letter head and there is no note mentioned regarding this.

Does this two issues cause any problem ?

Do I have to ask my ex company to add note in the letter saying that I left UK on previous Friday after attending the office( I am not sure whether they do.)

or is it ok?

to add to the above : I joined my current company 1st oct 2018.

I don't think there would be any problem if your total absences in any 12 months duration are well below 180 days. I have the same issue. If you worry too much, you can mention this as a bullet item in your cover letter or in the application form, against each of the travel you have a section that you can explain absence. In this slot, you can write something like: "Paid annual leave: Note that this travel is reported as an absence by my employer in their letter only by considering working days (Mon-Fri)"

Thanks for the suggestion, sure will add a note there. BTW I am on tier 2 general visa and I am submitting my ILR application under set(O) category, I hop this is correct :-).

Document section of application states following documents to be prodecued.

1)Evidence of XYZ's immigration status in the UK
2)Current Biometric Residence Permit for Mr XYZ
3) Declaration signed by Mr XYZ to confirm consent for the Home Office to request verification checks


What is the 1st document it is talking about? i thought it is same for 1 and 2nd option?
Where as for 3rd where can I get the sample consent letter?

Yes for Tier-2, you have to use SET(O) form with the categories:
Skilled Worker, Tier-2 or International Sportsperson
and subcategory
Skilled Worker.

There is no Tier-2 anymore.

really, I don't remember keeping any of those documents. I received my passport with entry clearance vignette on it when visa got issues.

It is ok if I submit the entry clearance vignette from passport as proof of immigration?

If you have not changed employer in the last 5 years, BRP does the job. Don't worry. This is for applicants who changed employers in the last 5 years.

Yes; it should be okay. Upload previous BRP along with the latest one and put a note in tho the relevant box against the document.

Hi,

I have filled the application and I'm ready to pay the fee and submit it, however I don't have latest bank statement and it will come tomorrow.

Can I submit the application and book the biometric appointment today and upload the documents tomorrow?

One more thing, I have landed UK in 12th Feb 2017 and completing 5 years in 12th Feb 2022.

On the basis of 28 day's, my eligibility to apply ILR starts from 15th Jan 2022, I am right.

Is it ok to upload NARIC certificate ? my appointment is on Saturday and I have uploaded the NARIC certificate which I got 5 years back. Is that enough or should i get the ecctis certificate ?

ok thanks Zimba,

I was bit worried as the document check list mention that we need to submit Ecctis letter.


But Now when I look at Ecctis UK NARIC transition 2021 FAQ, it is clearly mentioned that old NARIC certificate is still valid. Quoting the answer below.


"Yes. All statements issued by UK NARIC remain valid.

Employers, education providers, the Home Office, CSCS schemes are aware of the changes and should not treat UK NARIC statements any differently from those issued by UK ENIC or Ecctis.

The people that receive your statement(s) can check them using the method referenced on the document, if needed."

Hi,

Good news, Just now I received an email from home office stating that my application has been successfully.
I attended biometric on last Saturday and today I received the email.

I did not not expect it would be processed so fast as I applied on priority service which can take 5 days.

Finally, I would like to thanks Zimba and all others who answered my queries.
