Yet Again:Child benefits in question

Post by talreh20 » Sun Mar 20, 2022 8:39 am

Hi All,
I have read on https://www.gov.uk/child-benefit that 'there is no limit to how many children you can claim for'. I was under the impression the child benefit was paid for only two children? Can anyone shed some light on this?

Second question:
I have ILR, 3 kids, 1st child born in Pakistan, 2nd & 3rd child born in the UK. Wife and 1st child on FLR(M) (2nd extension applied) Spouse and dependant visa respectively.

The question: can i apply for child benefits for all of my three kids as per the link above? and the most important, can i apply for the first one as well who was born in Pakistan and is on FLR(M) dependant visa?

Third question: is it possible to apply for 2nd and 3rd child only, assuming if first child does not qualify for the child benefits?

Many thanks

While some welfare benefits will only pay towards two childrern, that is not the case with Child Benefit.

Read the links in the thread below, which are also on the other threads on Child Benefit/money for children subject to NRPF.

Hello JB

I appreciate your reply. However i completely forgot i already asked that question back in Oct 2019 and only checked my previous history and came to know my question was answered by CR-01 and yourself on.
claiming-benefits/child-benefits-t290396.html#p1835312

Is your advice still the same to my today's question i.e.

'for the benefit called Child Benefit, the child having no recourse to public funds does not matter as it is the parent who is claiming this benefit for children who live with them. The parent is the one who must be allowed to claim UK benefits. There is no limit for the number of children claimed for with this benefit.'

No. All the links clearly posted show that specialisat advice must be sought before claiming for a NRPF child. The same with claiming welfare benefits when the claimant has a NRPF partner; seek specialist advice before claiming. Read the links

Hi JB

I am a little confused here now. You categorically said in reply to my Oct 2019 post 'the child having no recourse to public funds does not matter as it is the parent who is claiming this benefit for children who live with them' and now you have said the links are clearly posted.

Has anything changed in the law between Oct 2019 to now which has forced you to say seek specialist advice?

There are now articles written on this, by the charities.

It's a bit like those who claim Council Tax Allowance/Reduction when they have a partner is is NRPF, a piece has recently been written about how claiming this could be taking public funds. The law hasn't changed.

I know you want somebody to tell you can can claim, but the advice now (in the links given) is to seek specailist immigration advice.

Having now read you previous thread, I can see that I also gave you a quote with the link, that stated:-

You should seek specialist advice before going any further if you, your partner or child have Limited Leave to Enter or Remain.

That link also states that you will not be told what is a public fund when you claim and that it is up to the claimant to make sure they can take that money.

And in your same previous thread, I also said that Child Benefit was not subject to the 2 child limit.
