Late application of FLR(M) - expired 27th march 2022 ( yesterday)

Hi All

For some reason ( purely due to my negligence ) I have missed the extension deadline (my wife's visa expired yesterday 27th March 2022 ) .. I somehow thought it is 2023 :(

I have just completed the form and am about to pay the NHS Surcharge ...

Just wondering if this is going to be a bigger problem ? or any chance that i may get through this without a huge bill?

E-LTRP.2.2. The applicant must not be in the UK –
(b) in breach of immigration laws (except that, where paragraph 39E of these Rules applies, any current period of overstaying will be disregarded), unless paragraph EX.1. applies.
39E requires a good reason. Provide it.

Thanks, @vinny for the help.

The ILR Same day application was approved.

I had 2 challenges in this application

1) I missed applying for the FLR (M) by 2 days
2) My wife had 2 trips out of 8 in the last 10 years to India ( that were over 180 days)

For issue 1 - I have given 2 pieces of evidence to support the late application

A) Medical history and health reasons for my wife ( that genuinely caused the delay) doctors' sick note ( issues for 4 weeks) ( which covered 2 weeks prior and 2 weeks after the visa expiry date)

B) The reason that my son is not well ( we did his covid test and email that we have sent to his school informing he is negative, still we are unable to send him to school for a couple of days)

For absence period of over 180 days :
Fortunately, I had many medical reports, bills & prescriptions saved ( I clicked pictures of reports & bills for sharing with one of the overseas medical consultants/family friends). Along with the application, I have attached as many as the details about what was the reason for extending the trip for over 180 days ( Including Original Flight tickets - showing the initially planned itinerary, Doctor's letters which I requested prior to application in support of evidence.


Submitted the application and got a same-day appointment after 10 days for biometrics. Received the confirmation next day ( in about 20 hours) and in 72 hours the biometrics card was delivered.
