Can I claim SMP (Statuatory Maternity Pay) if my visa expires & I leave UK?

Hi All,

I have a unique situation with respect to my SMP & even my HR is unsure in this scenario. I am currently on tier 2 ICT dependent visa in the UK. I am working full time & currently pregnant. I will qualify for my SMP in June & am legally entitled to get SMP.

Baby is due on 23rd Sept & I am planning to return back to India for my delivery in July. Our visa is expiring on 19th Sept & because I will be in India, I won't be able to renew it & would have to reapply when I come back with baby. Since I am qualifying for my SMP & fulfilling all the conditions, will I get it?
