PBS Dependent ILR Absences

Hello,

I am going to apply ILR for my wife from PBS Dependent (Tier 2 General)

I am in ILR from Tier 2 General

ILR Application Date Approximately 20 May 2022

Visa Current (1) 14-02-2020 to 14-02-2023
Visa Previous (2) 17-01-2017 to 07-01-2020
Visa Previous (3) 12-01-2016 to 31-01-2017
Visa Previous (4) 26-01-2016 to 25-02-2016

Absences from UK
Visa Current (1) 14-02-2020 to 14-02-2023
Absence 03/12/2021 – 10-04-2022 158 Days
(Will come into qualifying period where visa issued after Jan 11, 2018)

Visa Previous (2) 17-01-2017 to 07-01-2020
Absence 29-04-2017 To 25-06-2017 57 Days
10/01/2019 To 31/07/2019 202 Days
(Will come into qualifying period where visa issued before Jan 11, 2018)


Visa Previous (3) 12-01-2016 to 31-01-2017
Absence 18-03-2016 To 16-10-2016 212 Days
(Will not come into qualifying period)

Qualifying Period
Year 1 20/05/2022 - 20/05/2021
Year 2 20/05/2021 - 20/05/2020
Year 3 20/05/2020 - 20/05/2019
Year 4 20/05/2019 - 20/05/2018
Year 5 20/05/2018 - 20/05/2017

Is there any impact on Absences during Visa approved on 17/01/2017

No. That visa was issued in 2017. Absence limits ONLY apply for a PBS dependant visa period that was ISSUED on or after 11 Jan 2018. So only absences from 14-02-2020 and onwards are counted

The absences do not matter. You can be potentially be refused for some other reason
