Thanks both yes it is above the threshold without overtime.

So I shouldn't include any cover letter. In my payslip, I have a base salary and clearly mention overtime hrs and overtime pay.

Hi,

I am really sorry I know this question was asked 1000+ times but I am still confused about the ILR qualifying period.

I come across the documents and say this

WHEN TO APPLY
You and any dependants applying with you should apply before the end of your/their permitted stay in
the UK. There is a qualifying period to complete in most of the categories on this form. It runs either from

- the date on which you entered the UK with a visa in the relevant category; or, if you did not enter the UK with such a visa, from
- the date on which you were first granted permission to remain in the UK in the relevant category.

Does that mean the qualifying period starts entering the UK, not the visa Visa granted date? The second point seems only applicable if your leave granted remains in the UK not outside.

Different visa categories have different rules.

For all PBS and PBS dependent route visas, it is the initial visa issue date that you use and NOT the date of entry.

there is a question in the ILR application
Immigration history
When did you first enter the UK?

I hope they are not counting the 5yr(-28) from this date?

I am sorry I am stuck on one question

Have you previously lived in a country outside the UK including your country of birth?

I believe I have to provide my birth country name as well. I lived in more than 2 countries other than the UK. Many times I was in my home country for various reasons( some holidays, applying visa for other countries, etc) . I was in and out at least 4-5 times. My question is what should I write "Date you lived there from birth" and the "Date you lived there from till the date I left the first time ?"

or do I have to provide each date when I was in and out of my home country?

Sorry CR I wasn't very clear on this.

I first entered on a dependent visa in 2014 and left the country and reapply the visa home country and come back on tier 2 in 2017. So which date do I need to mention first? 2014 or 2017 ?

In the past, I made FLRFP applications. An application for a visa was refused after few 9 months and we applied for JR and judicial review outcome came year later. I already provided the details “An application for a visa was refused” and the date. I am not sure should it include the date of the outcome of the judicial review. The only option I can see.


In the form
Give details of what happened(Required)
An application for a visa was refused
  • I was deported
    I was required to leave
    I was removed
    I was refused entry at the border
And there is no option for volunteer leave

Any suggestions?

Judicial review has nothing to do with the immigration rules. If after the JR, the refusal was overturned then there was no refusal at all.

No decision wasn’t over turned. After this we left the country voluntarily And applied the tier 2 visa from home county.

Not sure how to mention this I the application. I already mention the initial date of visa refusal

The date is the original date of refusal. Choose 'I was required to leave'.

Your refusal has no impact on your ILR. Provided you've lived here legally for 5 years on the same visa Route. When you applied for your FLR, there would have been a letter that states you can apply for ILR after XX years. It's not a trick.
If you couldn't, you would have been told.
No sin in failing, you just have to try and try again!

I don’t think so I have any letter something like this.
If I have understood correctly there is no impact as long as I have lived here for 5yrs on the same tier2 visa it should be fine.

If you were refused for failing the requirement under the rules then there is no impact at all. If you were refused for reasons like deception/criminality then that can affect your good character for ILR.

The visa application was made based on private and family life in th UK and as usual response from the Home Office they didn't not find strong connection with the UK.

Also I want to check all my dependent have visa until next year 2023 . I believe I don't need to apply their visa with me as long they have valid visa they can apply (ILR) anytime before current visa expire?

Is that correct ?

I want to know about documents upload. I have 2 passport one is new other one is expired( Issued in 2015). In the last 5 yrs I only used the new passport.

Do I have to scan and upload the all passport or just I have used in the 5 yrs?
