Following the Court of Appeal’s judgment in the case of Akinsanya, the Home Secretary has reconsidered the EU Settlement Scheme (EUSS) requirements for applicants relying on being a Zambrano primary carer.

Such a person is a direct relative or legal guardian who, at the end of the transition period on 31 December 2020, had a right to reside in the UK as the primary carer of a British citizen because, without that right, the British citizen would have been compelled to leave the UK and the EU. Such persons did not have a right under EU law to acquire permanent resident status in the UK and are not covered by the Citizens’ Rights Agreements. They were included in the EUSS from 1 May 2019 as more generous national provision. As set out in the Explanatory Memorandum to the relevant Immigration Rules changes (HC 1919),[footnote 1] the intention was to protect those lawfully resident in the UK by the end of the transition period by virtue of a Zambrano right to reside, based on EU law.

The Court of Appeal judgment in Akinsanya held that the Home Office had erred in its understanding of regulation 16(7) of the Immigration (European Economic Area) Regulations 2016 in defining ‘a person with a Zambrano right to reside’ in the Immigration Rules for the EUSS in Appendix EU. However, the Court of Appeal found that, as a matter of EU law, a Zambrano right to reside does not arise where a person holds leave to remain.

The Home Secretary has carefully considered the Court of Appeal judgment and has decided that she no longer wishes that definition in Appendix EU to reflect the scope of the 2016 Regulations (which have now been revoked) but wishes it to reflect the scope of those who, by the end of the transition period, had an EU law right to reside in the UK as a Zambrano primary carer, in line with the originally stated policy intention. She therefore intends to maintain the requirement in sub-paragraph (b) of the definition that the applicant did not, by the end of the transition period and during the relevant period relied upon, have leave to enter or remain in the UK (unless this was under the EUSS).

This means applications will be considered under the existing Immigration Rules for the EUSS in Appendix EU. Applicants will be eligible for EUSS status in this category where, by the end of the transition period and during the relevant period relied upon, they met the relevant requirements of regulation 16 of the 2016 Regulations and did not have leave to enter or remain in the UK (unless this was under the EUSS).

From today, for a period of six weeks until 25 July 2022, people will be able to apply or re-apply to the EUSS as a ‘person with a Zambrano right to reside’ and be deemed to have reasonable grounds for having missed the deadline to apply, which was 30 June 2021.

For what I understand; people who hold /held leave to remain after Zambrano won't be considered by EUSS provision.
I might be wrong, I don't know

But that was what Akinsanya went for. And if you call the helpline there is a new option that says request papper application following zambrano rule .

In lay man terms, the rule stays as it is. People with LTR do not quality except if issued under Appendix EU i.e. pre-settled status. I can tell with this outcome the fight isn't over we are only back to status quo.

Unless you have pre settled, us on FLR FP won't be eligible so we have to continue with to apply under UK immigration

So it’s back to square one . I have had a scan through . What is this date for 25th July then . Those with leave to remain that expires before 25th July 2022. It’s all very confusing and upsetting. All this wait for nothing 😭😭😭😭

My FLR expired on 03/04/22, I have to look into applying again and the hefty fee.
We are really back to square one unless a divine intervention.
Hang in there; it has never been plain sailing with the Home Office anyway.

Pleaae what does this mean. So a parent of a British Citizen with flr has no right to EUSS?.

No change to settlement rules for Zambrano carers despite Akinsanya judgment
Zambrano carers who already have permission to stay in the UK under the Immigration Rules cannot use the EU Settlement Scheme as a fast track to permanent residence, the Home Office has confirmed. The department announced today that it would not be changing the rules in this area, despite having to reconsider them in light of a Court of Appeal judgment.

A non-EU citizen who was the primary carer of a British citizen (typically a child) could, under EU law and the case of C-34/09 Zambrano, get a derivative right to reside in the UK. These Zambrano rights were somewhat limited, which led many to apply for permission to stay under UK domestic law instead. When the post-Brexit EU Settlement Scheme came along, these Zambrano carers were allowed to apply, opening up the prospect of getting indefinite leave to remain for free – but only if they had not already switched into the UK Immigration Rules.

This situation was challenged, initially successfully in the High Court, but a subsequent trip to the Court of Appeal watered down the impact. Following Akinsanya [2022] EWCA Civ 37, the Home Office ultimately only had to go away and think again about whether it wanted to allow Zambrano carers to use the Settlement Scheme if they already have UK permission to stay. Its verdict is, no:

Thanks for that, at least we know. How soon can we apply to extend the FLR??
I called the UKVI and I was told as my FLR expired, I would have to start afresh (not extend) and contact an immigration lawyer. I burst out laughing at the ignorance.

Yes, your LTR clock starts again. That was why most people were advised to renew and not to let it expire. The home office isn't consistent; they have granted to some people who allowed their leave to expire but not to others. Each case is different though so I guess it is what is it.
It's a shame they have come to this after all the wait.

It's a shame they have come to this after all the wait.
Before my FLR expired, I called to ask the EUSS resolution centre and UKVI I should renew; I was advised not to do so as I can't have 2 applications at the same time; that I should wait for the Zambrano outcome 1st ; before deciding my next step.
So now I am an "overstayer"

Sadly yes. As Following the Akinsanya ruling, these two applications could co exist.
I will say it's actually better the ideas and guidance shared on this platform than to rely on information given by the EU resolution centre. They are not legal advisors.
