Overstayed visa before now applying as student dependent

Hi
I was in united kingdom on study visa in 2007 but later I could not not extend my visa and I overstayed my visa u till 2019.
I December 2019 I voluntarily returned to my home country
In 2020 I got married and have one daughter now my wife looking to apply for student visa she already have unconditional offer from Northampton University
Now my question is will my immigration history will have effect on our application. What is way out to this?
Please help me with this

Yes.

Your application is no longer subject to the specific 12-month time bar, but given your previous history it seems likely that an entry clearance officer would still be looking to refuse under the general grounds for refusing.

It depends what you mean by "solution" and to what.

As advised above, your previous decade-plus breach of conditions seems highly likely to be relevant to any new application. There is no specific solution for that. The damage is done.

Your options:

1. Apply and hope that your change in personal circumstances is enough to convince HO that you will now honour the immigration rules. Risk of refusal is high.

2. Don´t accompany your wife.

3. Your wife could study in a different country.

Does this matter my wife is main applicant and I am only dependent. I am told by consultant HO will not bother about me as dependent as I have to travel because of my daughter.

I’m sorry but your consultant sound like a rip up merchant and defying common sense, risk is high for rejection if you apply as dependent. As mentioned earlier damage is done already.

My wife got a student visa on 28/12/2022. I and my daughter applied for a dependent visa on 10/01/2023 and on 30/01/2023 I received an email from UKVI that they are asking for my wife and my bank statement from 01/10/2022 but I have some issues
1 we have withdrawn money from my wife's bank after we received her visa on 09/01/2023 .so we have funds with us in cash, not in a bank account.
2 my account was opened on 28/11/2022 but they are asking me bank statement from 01/10/2022
and another question is I had an overstayed visa in the UK before as well.is this mean if they are asking me for additional information they have passed me in suitability requirements
please guide me what is the best solution to this situation.

Rule of thumb- do not touch or tamper with any evidence in support of application especially financial evidence till each and everyone connected with and that will use such evidence have had successful outcomes on their visa application.

You were informed earlier outcome is not guaranteed and ECO could look for grounds to refuse.

For 1. If no time limit is given you to provide the financial evidence, make up the account to the state it was when your wife applied, keep for 28days and print statements afterwards. If time bound, try explain and provide evidence as best you can.

2. Though applying as dependant, a depiction of your own personal and financial circumstances is relevant to the application. You can only provide what you have, however convincing ECO that you just got an account few months ago is another thing.

As i have withdrawn money from my wife account can i put this money back into account and print statement and explain them why i have withdrawn money or i can show that money in my bank account as well .
The reason for withdrawing money was my wife had to travel to UK and we need to convert that money to pounds .this is exact wording of the email

Please provide the following documents:

In her application, your sponsor used bank statements in her name from HBL Bank for account xxx999 and Habib Metropolitan Bank for account xxx609.
- Please provide statements from these accounts that cover the period from 01/10/2022 to her most recent statement.

In your application, you have used bank statements from Habib Metropolitan Bank for account xxx391.
- Please provide statements from this account that cover the period from 01/10/2022 to your most recent statement

Did your spouse have enough money in pounds to show for her visa only or did she have enough to show for herself and dependents, which would have been more?

After the approval of her visa we take out funds from her account and converted to dollars because she wanted to travel to uk.my concern is can i show this money again in her account .
