ILR qualifying period start date

Hi
I have just joint the forum although have been reading posts on it for a few months now. It has been most helpful.:)
My question is when does the 5 year qualifying period for ILR under HSMP start? Is it

a) The date when initial leave was granted under HSMP (The current Set (O) guidance note says quote “There is a qualifying period to complete in most of the categories on this form. That period runs from the date on which you were granted leave to enter or remain in this capacity. Please do not apply more than 28 days before completing that qualifying period. “

b) Date of first entry in to the UK under HSMP

I got my initial leave to enter under HSMP on the 6th Feb 2004 but my actual entry date was 15th April 2004. I need to know whether the earliest I can apply for ILR would then be mid Jan 2009 (Per a) or Mid March 2009 (Per b)

My HSMP application was approved on 27.01.2004 and was incountry application as I was doing clinical attachment in a hospital but the passport has a stamp of HSMP visa dating 17.02.2004 till 27.01.2005.
Can anyone please advise me what should be the date for applying ILR as I am thinking to apply on 27.12.2008.
Am I right?

Will you please explain how you have calculated this? As I was already in UK and and visa was given to me on 17.02.2004 till 27.01.2005 means they had given me visa till 27.1.2005 for 1 year.

You applied in the UK and the date of the visa stamp is 17-02-2004, therefore, 5 years from that date you will qualify for ILR. You apply 28days before the end of that period i.e. 20-01-2009

I am in UK since sep 2000 doing clinical attachment and then converted my visa to HSMP.

Not all visas qualify though. Please name the visa you had before you received the HSMP?

I was thinking as my initial approval of HSMP was on 27.01.2004 may be thats why they gave me visa till 27.01.2005,it means that they have set my clock from 27.01.2004.

Why?

Qualification of the stay period is usually from the entry date. However, here it is from the stamp date as you were already in the UK.

Therefore 5 years from the day the HSMP was stamped in your passport. This is, as I said, because you were already here.

But the confusion is this that why they had given me visa till 27.01.2005 and inline I got extensions till 27.01.2006 and then till 27.01.2009.

That I know of that is just how it works. Then up to the visa holder to apply for an exntension when needed up until ILR requirement has been met.
